Why Court Has Set Mike Sonko Free in Ksh357 Million Graft Case
Former Nairobi Governor Mike Sonko has been cleared of charges related to a corruption case involving Ksh357 million by an anti-corruption court.
In a ruling issued on Wednesday, February 7, the court released Sonko and 16 others citing insufficient evidence.
Therefore, it was determined that the proof submitted to the court lacked the necessary substance to justify a guilty verdict.
“The evidence is inadequate to sustain the charges levelled against the accused persons,” Magistrate Eunice Nyutu ruled.
The Court criticized the prosecution for providing only six witnesses, despite initially suggesting that the case relied on the testimonies of 38 individuals.
In a prolonged legal proceeding spanning more than four years, Mike Sonko, along with 16 others, faced allegations of embezzling public funds during his tenure as the governor of Nairobi.

Accusations were made against Sonko and others, including a private liability company, for misappropriating Ksh357 million designated for projects of the Nairobi County Government.
The alleged embezzlement is said to have occurred from May 24, 2018, to March 28, 2019, predating Mike Sonko’s removal as Governor on December 3, 2020.
Two years afterwards, the US government prohibited Sonko and his family from visiting the United States due to allegations of corruption.
Mike Sonko was acquitted in his second multimillion-shilling corruption case.
In December 2022, an Anti-Corruption Court acquitted Sonko over a Ksh20 million graft case ruling that the prosecution had failed to prove the case beyond reasonable doubt.
The impeachment that arose from the graft cases saw Mike Sonko barred from vying as Mombasa governor in the 2022 general election.Â
