Teenager, 15, in Court for Defiling and Infecting 6-Year-Old Girl with HIV

A 15-year-old minor has been brought before an Eldoret court on charges of defiling and transmitting HIV to a six-year-old child.

The accused, a Grade Eight student from a school in Moiben Sub County, is reported to have been born with the virus.

Given the sensitive nature of the case, the plea was taken privately.

The juvenile is charged with defiling another minor, contrary to Section 8(1) and Section 8(2) of the Sexual Offences Act, 2006.

The charge sheet alleges he defiled the six-year-old girl on various occasions between January and April 2024 in Kambi Nairobi area, Kimumu estate.

He is also facing a charge of intentionally transmitting HIV, contrary to section 26 of the Sexual Offences Act, 2006.

The accused, represented by lawyer Oscar Oduor, pleaded not guilty to the charges before Eldoret Chief Magistrate Dennis Mikoyani.

Lawyer Oduor requested the court to grant the accused lenient bail terms, citing that he is also a child in need of care and protection.

“Considering the case involves both the accused and the victim as minors requiring care and protection, I respectfully ask the court to grant lenient bail terms,” Mr. Oduor argued in court.

Following the lawyer’s request, the court set the bail amount at Sh50,000 with a similar surety.

The case will be revisited on May 13 for further instructions regarding pre-trial proceedings, considering the involvement of two minors who both require care and protection.

Two weeks earlier, a 14-year-old from the same sub-district was charged with defiling a 9-year-old boy.

Police are investigating the accused for similar cases where he is suspected of defiling seven other minors, including four girls and three boys.
