Brian Mwenda Speaks On Prior Relationship With LSK Boss

Mwenda’s attorney, Danstan Omari, submitted a lawsuit in which he refuted all the allegations against him as unfounded and rejected the contentions that he evaded arrest by Directorate of Criminal Investigations (DCI) detectives and is a flight risk.

“Statements that I am a flight risk are merely speculative and now that I understand that I am under investigation, there is no reason for me to get out of the court’s jurisdiction nor abscond attending court but this can be taken care of by the court imposing an order for me not to leave the courts jurisdiction during the pendency of this suit unless otherwise permitted by this court,” Mwenda said in his affidavit.

Mwenda also urged the court to prohibit the Law Society of Kenya (LSK) from further involvement in the case, arguing that only the National Police Service (NPS) and the Office of the Director of Public Prosecutions (ODPP) have the authority to investigate and prosecute cases.

Mwenda’s revelation that Law Society of Kenya (LSK) President Eric Theuri, who has been outspoken in his dismissal of Mwenda as a quack, used his authority to bail out Mwenda and his friends from various police stations whenever they were arrested for drinking was a significant development in the case.

Due to his close relationship with Theuri and Vice President Faith Odhiambo, Mwenda wishes to prevent them from representing the Society.

“In the unlikely event that I am put on a defence, I may be calling both of them in this case as my defense witnesses,” Mwenda further stated in his affidavit.

Mwenda, who has known Theuri and Odhiambo for two years, claimed that they have immersed themselves in the case to prevent him from disclosing sensitive information about them.

The purported fake attorney also claimed to have played a significant role in Theuri’s 2022 presidential campaign.

Mwenda was apprehended on October 17 after he reported to the DCI headquarters.

LSK flagged him for impersonating another attorney and practicing without a license, which led to his arrest.

At the time, it was widely believed that he had argued and won 26 cases, but LSK has since refuted this claim.
