Bail Plea: Mathe Wa ngara’s Health Concerns

As she is ill, Nancy Kigunzu aka Mathe wa Ngara has asked the JKIA law court to release her on parole.

Kigunzu, who collapsed during the bail hearing on Monday, told the court that her medical condition requires continuous monitoring and medication and that she fears her condition will worsen if she is denied bail.

Kigunzu, who appeared before magistrate Njeri Thuku, denied allegations that she is a flight risk and will evade court proceedings.

Kigunzu’s attorney Danstan Omari stated that although she was arrested in Nairobi’s central business district, her children were arrested in a residential area, arguing that she has a residence and the police are aware.

She also refuted claims that she would interfere with witnesses in the case, stating that all of the witnesses are police officers and that she lacks the authority to do so.

Kigunzu’s co-accused Teresia Wanjiru and two others, who also sought parole, were also present in court.

The accused, through their attorneys, argue that the prosecution has not established compelling reasons to justify their continued detention.

The prosecution requested that the court deny parole to the four defendants so as not to poison society.

According to the prosecution’s affidavit, the accused should be isolated from society so that they do not continue polluting the society in which they reside.

Stephen Chesire, who is investigating the case against the accused, claims that if the accused are released, they will abscond and that they are a flight risk whose residence is unknown.

The prosecution further states that they intend to interrogate and record the statements of key witnesses, which may lead to the arrest of additional co-conspirators.

“Should the respondents be released before the investigations are complete, there is a likelihood that they will interfere with the investigations and compilation of evidence,” the court was informed.

The prosecution asserts that it has substantial evidence against the defendant.
