Babu Owino’s Court Room Return for Firearm
Babu Owino, member of parliament for Embakasi East, is scheduled to request the return of his firearm in court on Tuesday, following his acquittal in a case involving the alleged misuse of the weapon.
The case involves the gunshot of DJ Evolve, also known as Felix Orinda, who survived a neck injury in a nightclub in Kilimani, Nairobi County, in the year 2020.
In the course of their investigation into the incident, authorities confiscated Babu Owino’s firearm.
DJ Evolve testified virtually during the trial, stating that he had no memory of the events that transpired on the night of the shooting.
He explained that he didn’t realize his predicament until he discovered himself in an ambulance.
Notably, DJ Evolve stated that he did not see Babu Owino with a firearm that night and was unaware of the weapon that caused his injury.

As a response, Babu Owino pledged to stand by DJ Evolve throughout the ordeal. Not only did he cover DJ Evolve’s hospital expenses, but he also assisted him with his daily expenses.
The second witness, Babu Owino’s bodyguard, testified that the lawmaker did not use his firearm on the day of the incident.
Instead, he clarified that Babu Owino had taken the pistol for maintenance and inspection because it had jammed, indicating that it was not intended to be used violently that evening.
The Magistrate Court ruled on August 29 that the prosecution had insufficient evidence to establish Babu Owino’s guilt beyond a reasonable doubt, and therefore acquitted him.
Judge Bernard Ochoi remarked that the prosecution had failed to establish that the gunshot was fired by Babu Owino. In addition, he noted that the prosecution had failed to demonstrate that Babu Owino was under the influence on that day.
“Samples taken don’t show that the investigating officer desired to know the alcoholic content in babus blood.”
As a consequence, Babu Owino was released and the attempted murder charges against him were dropped.
“This judgment has gone the way the almighty God wanted it to go. That is how God wanted it to go,” Babu said after his acquittal.
