Ruto Nominates Isaac Rutto to Judicial Service Commission

President William Ruto nominated former Governor of Bomet Isaac Ruto and Caroline Nzilani Ajuoga to the Judicial Service Commission (JSC) on Wednesday, May 3.

Speaker of the National Assembly Moses Wetangula announced during a session at the Parliament Buildings in Nairobi.

Ruto and Nzilani were nominated to serve as public representatives on the Commission led by Chief Justice Martha Koome.

National Speaker Moses Wetangula stated, “Under the provisions of Standing Orders 42, I wish to convey a message from President William Ruto in which he has nominated individuals to the Judicial Service Commission.”

Wetangula stated, “In the message, the President conveyed that, under the powers granted to him by Article 128 of the Constitution and Sections 3 and 5 of the Public Appointment Act of 2011, he presented the list of nominees.”

Before their appointments are ratified, their names will be forwarded to the Justice and Legal Affairs (JLAC) Committee for formal review.

By the Kenyan Constitution, the JSC is an independent commission.

The JSC’s primary function is to promote and facilitate the independence and accountability of Kenya’s Judiciary.

The commission is in charge of the appointment, promotion, and removal of Kenyan judges and magistrates.

The Judicial Service Commission (JSC) consists of eleven members. Including the Chief Justice, who serves as chairman. The Attorney General, a representative of the Law Society of Kenya. And additional members appointed by the President with the approval of Parliament.

Article 171 of the Constitution of Kenya establishes the qualifications and criteria for appointment, which governs the recruitment of the remaining members of the JSC.

The President must appoint four members, subject to parliamentary approval, as follows:

The Parliamentary Service Commission nominated two members, one of whom must be female; the Public Service Commission nominated one; and the Federation of Women Lawyers in Kenya nominated one.

To be eligible for appointment to the JSC, a candidate must satisfy the following requirements and qualifications:

  1. be a Kenyan citizen;
  2. Have at least 15 years of experience in a profession pertinent to the JSC’s duties;
  3. Possess integrity, objectivity, and sound judgment;
  4. Possess expertise and experience in legal, governmental, or public administration matters; and
  5. Not be a member of Congress or a county assembly. Or hold any other public office or position incompatible with JSC membership.

The recruitment process for JSC members involves a rigorous selection process that includes nominations, public vetting, and parliamentary approval.

This process ensures that only the most qualified candidates join the commission.

On Tuesday, March 17, 2022, Chief Justice Martha Koome will meet with members of the Judicial Service Commission.

The JSC’s specific functions include:

  1. The JSC is responsible for appointing judges and magistrates in Kenya via a transparent and competitive process.
  2. The JSC is responsible for promoting judges and magistrates based on merit and disciplining them if they engage in misconduct or unethical conduct.
  3. The JSC is responsible for managing the Judiciary’s finances, including the allocation of resources for the operation of the Judiciary.
  4. The JSC is responsible for developing policies for the Judiciary, including policies for the efficient administration of justice and the protection of all parties rights in court cases.
