    Petition Filed Seeking Removal Of Chief Justice Martha Koome From Office

    A formal request has been submitted to the Judicial Service Commission (JSC) urging the dismissal of Chief Justice Martha Koome from her position.ย 

    The petitioner, Michael Kojo Otieno, contends that Chief Justice Koome did not adhere to legal procedures when appointing members to the tax appeal tribunal.

    The petition asserts that during the selection process for individuals to serve on the tax appeal tribunal, Chief Justice Koome failed to uphold honesty in executing the powers vested in her by the Tax Appeal Tribunal Act, which are derived from her role as a judicial officer.ย 

    The document specifically notes, “While appointing persons to serve at the tax appeal tribunal, the judge failed to be honest in the execution of powers conferred to her by the Tax Appeal Tribunal Act based on powers conferred to the judge as a judicial officer…”

    Kojo further alleges that the Chief Justice lacked transparency and diligence in her actions, contending that she discriminated against applicants who sought membership on the board.

     According to Kojo, the Chief Justice exceeded the specified requirements by appointing more members than allowed under section 4b of the Tax Appeal Tribunal Act.

    The petitioner asserts that Chief Justice Koome’s actions in appointing members to the tax appeal tribunal were not only in violation of the law but also rendered her unsuitable for holding public office. 

    He argues that these actions are “illegal, null and void,” and therefore, Chief Justice Koome should be deemed unfit to continue in her role.

    The documents presented to Gossipa2z suggest that the petitioner is calling for Chief Justice Koome’s removal from office due to the perceived breaches of the law in the appointment process.
