Nairobi High Court Halts Kenya Railways’ Eviction of Pastor Ng’ang’a

Wednesday, June 21, 2023, the High Court in Nairobi issued an injunction prohibiting Kenya Railways Corporation from evicting Pastor James Ng’ang’a from a plot of land on Haile Selassie Avenue.

The court granted the injunction at Ng’ang’a’s request after determining that the pastor who leads the Neno Evangelism Centre, which sits on the land, raised a valid concern.

Pastor Ng’ang’s secretary confirmed to Gossip2z that the High Court extended the eviction orders to other government agencies, such as the National Police Service, which would be instrumental in carrying out the eviction.

The secretary confirmed that the injunction was issued yesterday in response to an earlier order by Kenya Railways ordering the church leadership to vacate the land.

Ng’ang’a informed the court that he has legally purchased and occupied the land for more than a decade.

Pastor Ng’ang’a stated through attorney Cliff Oduk that he purchased the land for Ksh8 million on June 22, 2011. The land’s value has since increased.

The religious leader also disclosed that he inherited the land from Amin Mohamed Rahim Bhanjee, who held a 99-year lease beginning in October 1994.

In his arguments, Ng’ang’a stated that after Bhanjee’s death, the government issued Farida Amin Mohamed a certificate of confirmation of grant on July 17, 1998, following the conclusion of an inheritance case.

“We have the correct deed to the property. However, Kenya Railways asserts that the land is a railway reserve, and they have been attempting to evict Ng’ang’a for years,” he argued.

The court’s decision is a temporary victory for Ng’ang’a in a case that will likely go to trial later this year. If Ng’ang’a prevails in court, he will retain ownership of the property.

If Kenya Railways prevails, Ng’ang’a will be required to vacate land that the government claims is a railway reserve.

The case’s outcome could have repercussions for other landowners facing eviction from land believed to be railway reserves.
