    High Court Nullifies Uhuru Cousin’s Appointment to Key Government Role

    High Court Nullifies Uhuru Cousin’s Appointment to Key Government Role

    After just one year in office, Captain Kungu Muigai, appointed as the Chairperson of the Kenya Cultural Centre Council by the government, has faced a setback following a recent court decision.

    The High Court ruled that his appointment was invalid after a petition challenged it.

    David Njoe Kithunka filed the petition, arguing that the former Cabinet Secretary, Ababu Namwamba, acted unlawfully by appointing Muigai. Kithunka claimed that Namwamba ignored the Kenya Cultural Centre Council’s authority, which is supposed to make such appointments, and appointed Muigai directly.

    Justice Lawrence Mugambi declared the appointment null and void, stating that Muigaiโ€™s appointment as Chairman, effective January 20, 2023, violated the law.

    “The appointment of Capt. Kungu Muigai as Chairman of the Kenya Cultural Centre Council is invalid and void,” Mugambi said. He further ruled that the appointment contravened the Kenya Cultural Centre Act and violated the rule of law under the Constitution.

    Muigai was set to serve as Chairperson until January 20, 2025, but the court did not address the impact of his nearly completed term.

    Muigai’s appointment was made on January 21, 2023, through a gazette notice by Namwamba, which stated his role as both a member and Chairperson.

    The court directed the Kenya Cultural Centre Council to elect a new chairperson according to the law. “The Council shall elect its chairman in accordance with the Kenya Cultural Centre Act,” the ruling concluded.
