EACC Secures High Court Order to Freeze Ksh.62M in Investigation of Ukur Yatani
The Ethics and Anti-Corruption Commission (EACC) has secured a High Court order to hold onto $460,000 (Ksh.62,100,000), which it took as part of its investigation into former Cabinet Secretary and Marsabit Governor Ukur Yatani.
The funds, consisting of 4,600 USD 100 bills, were taken from Yatani’s nephew, Ibrae Doko Yatani.
Justice Esther Maina issued the freezing orders on May 3, which will remain effective for six months.
“I find the grounds for preserving the funds reasonable. Therefore, the application to hold onto 4,600 USD 100 bills from the respondent’s residence on April 24, 2024, is approved. The order will last for six months in accordance with Section 56(3) of the Anti-Corruption and Economic Crimes Act (ACECA),” the court stated.
“The order must be served to the respondent within seven days from today. No order regarding costs will be made. This is the decision.”
EACC informed the High Court that the large sum of money suggested possible links to corruption or unexplained wealth.

The commission argued that Yatani might be involved in money laundering, prompting an investigation into the source of the funds.
The court was told that during the relevant time, Ibrae Doko Yatani’s company, Al Habib Enterprises, irregularly received Ksh.71,790,897 from Marsabit County Government.
EACC, through its lawyer Jackie Kibogy, expressed concern to Justice Maina that without a court order for continued custody of the funds, Ibrae Doko Yatani might demand their release and potentially move or spend them, which could hinder any forfeiture proceedings, affecting the public’s interest.
The funds may also be used as evidence in any potential criminal charges.
Ukur Yatani, alongside Marsabit Governor Mohamud Mohamed Ali, top county officials, and close family members, is under investigation for potential theft of public funds, abuse of office, procurement issues, conflict of interest, and unexplained wealth.
