Arrest Warrant Issued Against Four Witnesses In Arror And Kimwarer Dams Scandal

A Nairobi magistrate has directed detectives to arrest and produce in court four witnesses lined up to testify in the graft case against former Treasury CS Henry Rotich.

Anti-Corruption Court magistrate Eunice Kagure Nyutu issued warrants of arrest against Mutungu Mwai Wanjohi, Boniface Mamboleo, Samuel Kimutai Kosgey, and Cecilia Kaluka after they failed to show up in court despite having been bonded last week.

The orders came after the prosecution had asked for adjournment saying the Director of Public Prosecutions needed to give new directions in the matter.

The Office of the DPP is currently without a substantive director and nominee Renson Igonga is yet to be sworn in.

They thus sought to have the hearing taken out for this week awaiting further instructions from the incoming DPP who could be sworn in on Thursday.

The magistrate however said her court must ensure matters are heard expeditiously.

“I find the reasons given by the prosecution seeking to take out the hearing dates for this week pending the post-vetting of the incoming DPP is not justifiable. This court cannot be held hostage through unverifiable instructions given to the prosecutor by word of mouth and therefore the application for adjournment is denied,” Nyutu ruled.

“Further this court issues warrants of arrest for the said witnesses Mutungu Mwai Wanjohi, Boniface Mamboleo, Samuel Kimutai Kosgey, and Cecilia Kaluka. “

Investigating officer Wellington Ngeno was directed to ensure the four were arrested and produced in court in one hour.

“These are public servants who are in public offices. I direct the DCI to arrest and bring them to court, ” she said.

A total of 11 witnesses had been bonded by last week and we’re expected to testify in marathon hearings that were scheduled for this week.

However, only David Walunya Ong’are was in court but could not testify because he was unwell.

He was also ordered to produce by 2 pm today medical documents showing he was unwell and unable to testify.
