Simplified Guide: Effortlessly Claim Refunds and Replacements for Supermarket Purchases

President William Ruto strengthened rules allowing consumers to demand refunds and replacements for goods that do not meet market standards on Thursday, June 15.

In his inaugural 2023/2024 budget, President Ruto authorized the Competition Authority of Kenya (CAK) to assist Kenyans in seeking redress via replacements or refunds.

Cabinet Secretary of the National Treasury Njuguna Ndung’u announced that the Competition Authority will assist Kenyans in seeking redress from predatory retailers, supermarkets, insurance companies, and other merchants.

“About consumer protection, the Authority will monitor and investigate emerging consumer issues in the utility sector, pharmaceuticals, digital financial services, e-commerce, insurance, aviation, and basic commodity safety.

In addition, the Authority will seek redress through replacement or refunds for consumers affected by dark commercial patterns, scams, and fraud in the digital economy, Njuguna announced.

Where To File

According to the Kenyan Competition Authority, dissatisfied customers can file complaints directly with it. CAK receives complaints submitted via telephone, mail, and fax. The contact information is available on the site’s homepage.

The authority noted that Kenyans can also file complaints by visiting its offices in various parts of the country, beginning with its main office in the CBK Pension Towers on Harambee Avenue in Nairobi.

The customer must fill out a consumer complaint form and provide all pertinent information, including receipts, upon visiting the company’s offices. The purchased items may also be necessary for this process.

When the Consumer Protection Department receives a consumer complaint, it will acknowledge the complaint and inform the consumer of any information gaps.

It will then analyze the provided information before contacting the accused supermarket retailer to obtain additional details about the case.

The Competition Authority of Kenya, in collaboration with other government agencies such as the Kenya Bureau of Standards (KEBS), notifies other consumers if the investigation reveals that the goods were unfit for consumption or did not meet market standards.

The Competition Authority of Kenya’s website states, “The Authority may then apply administrative remedies to resolve the complaints, including refund, replacement, or repair of goods, withdrawal of misleading representations, recall of unsafe goods, and public notice of the existence of such goods.”

However, complaints that fall outside of their jurisdiction are forwarded to the appropriate government agencies.

“Complaints that the Competition Authority of Kenya is unable to resolve are referred to the Office of the Director of Public Prosecutions (ODPP) after exhaustive investigations have been conducted.

The law states, “Upon conviction, a person who violates the provisions of Part VI of the Act is subject to imprisonment for a term not exceeding five (5) years or a fine not exceeding Ksh10 million, or both.”
