Senator Khalwale’s Demand: ‘Toto’ Shimanyula Faces Sh200M Price Tag Over Defamation Allegations
Senator Boni Khalwale from Kakamega has demanded that businessman Cleophas Shimanyula, also known as Toto, compensate him with Sh200 million for purported defamatory statements made against him.
The Senator has given the tycoon a 48-hour deadline to offer an apology for the purported defamatory statements he has been accused of making.
Khalwale, represented by his lawyer Danstan Omari, has requested Cleophas to send a letter within the next 48 hours, confirming his intention to promptly issue an apology and withdraw the comments he made concerning the passing of his farmhand, Moi Kizito.
“We demand from you, that you confirm to us in writing, within the next 48 hours that you shall immediately compensate our client Sh200 million for damaging his reputation and accept liability for defamatory statements published in the article” reads the demand letter in part.
Khalewale states that he will take legal action and file a lawsuit if Cleophas does not meet the specified requirement.

The Senator asserts that subsequent to the defamatory comments, he has become a target of animosity, facing public disdain. He is now viewed with suspicion by numerous officials at both the County and National government levels, as well as by individuals and groups who previously held him in high esteem.
“It is clear from the totality of the foregoing that the overarching objective was to create malicious falsehoods aimed at maligning Our Client to deviously orchestrate his removal from office and or his wrongful arrest and prosecution for the untimely death of his employee,” reads the letter.
Omari emphasized that the unjust treatment of our client should not be downplayed or considered beyond resolution any longer.
The lifeless body of Kizito Moi, the farmhand employed by Khalwale, was found on January 28 in Khalwale’s shed, surrounded by both blood and mud.
He worked for him for two decades.
