Residents Of Contested Kirima Land Now Want A Probe Into How Ex-MP Acquired It

A portion of the inhabitants residing on the contested Njiru property that belonged to the family of the late politician Gerishon Kirima has been ordered by the High Court to deliver their legal documents to all the involved parties and to appear in court on January 24, 2024, for further instructions.

Enjoinement is sought by the residents in a legal proceeding where they contest the court’s ruling that they must vacate the contentious property by the conclusion of this year.

The inhabitants advocate for the Directorate of Criminal Investigations (DCI) to investigate the circumstances surrounding Kirima’s initial acquisition of the land.

The residents petitioned the court for an order compelling the DCI to examine the documents presented in court and determine which of Italian Dominico De Masi Kirima and Dominica De Masi is the rightful proprietor of the disputed parcel of land.

Residents, represented by attorney Danstan Omari, have requested that the DCI examine the documents submitted by the family of the purported original owner of the land, the late Italian Dominico De Masi, to determine whether the property was lawfully transferred to the Kirimas.

Additionally, they have requested that the National Lands Commission investigate the land’s title deed via letter.

The most recent action follows Environment and Land Court judge Samson Okong’o’s October 23 ruling, in which he identified former Starehe MP Gerishon Kirima as the property’s legitimate owner.

The occupants were given until December 31 to vacate and transfer ownership of the property to the estate of Kirima, as directed by Okang’o.

The inhabitants expressed that the current verdict if implemented, would have severe repercussions on them and would impede the region’s economic progress.
