Omtatah Alleges Ksh.200M Bribe to Drop Finance Act Petition
Senator Okiya Omtatah of Busia has asserted that he has been offered a sum of money equal to or greater than Ksh.200 million to retract his petition against the Finance Act 2023.
During his speech on Tuesday at the People’s Anti-corruption Summit, Omtatah said that he had declined the offers because they were an effort to undermine the legitimacy of the judicial system.
“We need to make sure that we comply with the law. They think that everything comes at a cost. If you look at the amount of money that has been offered to me for me to withdraw the petition, you will see that it has reached 200 million. Omtatah stated, “But I tell them, my price is one; if you can’t govern, vacate the office for those who can govern.”
The Senator reaffirmed his dedication to preserving the tenets of justice and waging war against corruption in his remarks.

He emphasized that his petition was inspired by a genuine concern for the welfare of the people and the economy, and he swore that he would not give in to any attempts to compromise the integrity of the legal process. He also said that his petition was motivated by this genuine care.
On June 30, as a result of a petition that was submitted by Omtatah, the High Court decided to temporarily halt the execution of the Finance Act 2023.
A stay of execution was issued by Lady Justice Mugure Thande, preventing the law from going into force while the case brought by Omtatah is being heard and decided.
In following years, the state petitioned the court to have the decrees overturned.
In a decision that was handed down on July 10, however, judge Mugure Thande chose not to overturn the injunction that had suspended the Finance Act 2023.
“The petitioners have proven that they have a prima facie case….there is merit in granting conservatory orders,” the judge pointed out. “There is merit in granting conservatory orders.”
