    Office Of The Opposition Bill Seeks To Increase Azimio’s Representation In Parliament

    The One Kenya Coalition within the Azimio La Umoja will gain more parliamentary representation beyond the Leaders of Minority in the Bicameral House if the Leader of Opposition Bill 2023 is enacted.

    The proposed legislation categorized as a Money Bill according to Article 114 of the Constitution incorporates suggestions and perspectives from the public as outlined in the National Dialogue Committee Report. These encompass issues such as Electoral Injustice and Multiparty Democracy, among others.

    The proposed legislation, identified as a priority for discussion by the National Assembly leadership, outlines the responsibilities of the Leader of the Opposition. These duties encompass advocating for the Opposition’s interests, presenting an alternative policy agenda, and offering constructive criticism of government policies.

    “The Leader of Opposition Bill 2023 is among those prioritized by House Business Committee as members return from recess,” National Assembly Speaker Moses Wetangula said in an interview.

    The legislation also delineates the roles of two Deputy Leaders of the Opposition, who will serve as the primary aides to the Leader of the Opposition. They are tasked with acting on behalf of the Leader of the Opposition in carrying out their responsibilities.

    The responsibilities of the Opposition leader encompass representing the opposition’s interests, presenting an alternative policy agenda, offering constructive criticism of government policies, advocating for transparency, accountability, and good governance in public affairs, and fostering cooperation and positive engagement between the government and opposition to advance national interests.

    Some individuals are engaging in state ceremonial functions and international parliamentary events on behalf of the Opposition. They are also working to enhance public awareness and comprehension of the opposition’s role in a democratic state.

    The leader of the opposition must be appointed, sworn in, and can be removed within seven days following the President’s swearing-in ceremony after a general election. According to Article 92A of the Constitution, the Chief Justice is responsible for administering the oath of office to the Leader of the Opposition, as determined by the Independent Electoral and Boundaries Commission.

    The Leader of the Opposition will take the oath of allegiance and the oath of office, as outlined in the Schedule, administered by either the Chief Justice or, if the Chief Justice is unavailable, the Deputy Chief Justice. This act signifies a solemn commitment to uphold the Constitution and work in the best interests of the nation.

    If the appointed Leader of the Opposition, as identified by the IEBC, declines or is incapable of taking the oath of office within the stipulated seven-day timeframe, the Chief Justice will then proceed to administer the oath of office to the individual designated to assume that position based on a resolution from a party or coalition agreement. The Leader of the Opposition will then undertake the duties and obligations of the office following the conclusion of the swearing-in ceremony.

    The office of the opposition leader can be eliminated through a resolution passed by the political party or coalition of parties that secured the second-highest number of votes in the most recent presidential election.

    Additionally, if an individual receives a prison term lasting a minimum of six months and has utilized all possible avenues for appeal or review concerning the case, or if the person is determined, according to any applicable law, to have mishandled or exploited their position, or if the person is incapable of fulfilling the responsibilities of the office due to mental or physical limitations.

    After the Leader of Opposition is removed as per subsection (6), the Chief Justice is required to immediately administer the oath of office to the individual specified for that position by a resolution from a party or coalition agreement.

    The payment and perks for the Leader of the Opposition and the Two Deputy Leaders of the Opposition will be funded from the Consolidated Fund. The Leader of the Opposition’s office will be provided with the essential facilities, resources, and staff needed to efficiently carry out their responsibilities as outlined in this Act.
