ODM Writes to Senate Over Bill Seeking to Extend Presidential Term Limit
The Orange Democratic Movement (ODM) has formally expressed its dissent to the Senate regarding a proposed bill aimed at extending the term limits for the president and other elected officials from five to seven years.
In a letter dated October 25, ODM articulated its opposition, citing the bill’s violation of the constitution as the primary reason for its stance.
“We wish to register our deep concern by categorically rejecting the proposed Constitution of Kenya (Amendment) No. 2 Bill, 2024, in its entirety.
“This rejection is rooted in the infringement of Article 255 (1) of the Constitution of Kenya, 2010, and the undermining of its fundamental structure,” stated ODM Executive Director Oduor Ong’wen.
Ong’wen further emphasized that, according to the constitution, any amendments about the constitution’s supremacy and the presidential term of office must be sanctioned through a referendum.

He argued that the proposed bill poses a threat to the core of Kenya’s democracy, compromises the sovereignty of its citizens, and contradicts the essential principle of public participation.
The ODM Executive Director called on the Senate to dismiss the bill and requested a written response from the Senate upon receiving and considering the letter.
“We strongly urge the Senate to reject this bill and uphold the values of good governance, the rule of law, and the constitutional mandate for authentic public participation through a referendum.
“We seek the opportunity to present further oral submissions on this Memorandum. We also request written confirmation of the receipt and consideration of this memorandum, along with an explanation of any sentiments expressed by the Senate that may lead to its non-consideration,” Ong’wen stated.
The bill, introduced by Nandi Senator Samson Cherargei, has sparked a significant discussion among Kenyans and elected officials, with a majority of citizens opposing it.
