MP Ali Orders Auction of Kenyatta’s Property to Settle Debt

To recover Ksh500,000 owed to him, Nyali MP Mohammed Ali instructed a local auctioneering firm to auction off a portion of former president Uhuru Kenyatta’s properties.

In a letter signed by Adrian Kamotho Njenga and obtained by GossipA2Z, the lawmaker stated that he had not yet been compensated for his defamation victory against the Kenyatta family.

The representative listed several items slated for auction, including 40 dairy cows valued at Ksh150,000 each, a cooling plant with an estimated value of Ksh400,000, computers, seven reception seats priced at Ksh6,000 each, office desks valued at Ksh30,000, office chairs valued at Ksh20,000, and printers priced at Ksh14,000.

The auctioneers were instructed to return the warrant by August 30, 2023, with an endorsement attesting to the execution of the auction.

“We hereby authorize and instruct you to execute the annexed warrants of attachments and sale… for the recovery of the decretal sum ordered by the High Court of Kenya on October 11, 2022, and for the settlement of all costs, charges, penalties, interest, and expenses arising therefrom or incidental to the execution of our instructions,” a portion of the statement read.

“We hereby agree to indemnify you against all costs, damages, losses, and expenses you may incur in the lawful performance of your duties as licensed auctioneers at all material times,” the attorney added.

Defamation suit

In the lawsuit, the defendant alleged that the legislator defamed them by asserting that they exploited dairy farmers by charging low milk prices.
Ali argued in his defense that the lawsuit was an attempt by the company to prevent him from voicing public concerns.

“The Bill of Rights provides protection and guarantees for natural persons as individuals, but not for limited liability companies,” Ali’s attorney Njenga stated on his behalf.

Justice Hedwig Ong’udi of the Constitutional and Human Rights Division of the High Court, however, dismissed the case after determining that the matter belonged in civil court.

The company was ordered to file the lawsuit in the appropriate court. In addition, the judge upheld the MP’s arguments and ordered the milk processor to pay the costs.

She ruled that the petition was flawed and that no rights were violated when Ali criticized the company.
