Legal Roadblock: Petition Seeks to Halt Vetting of Noordin Haji as NIS Director

Director of Public Prosecutions (DPP) Noordin Haji’s bid to succeed Philip Kameru as the nation’s top spy now faces a double obstacle in the form of a petition to the Public Service Commission by a coalition of civil society organizations and a lawsuit filed in Nakuru High Court.

Under the auspices of the National Integrity Alliance, civil society organizations petitioned the PSC to dismiss Haji for gross misconduct, incompetence, and noncompliance with chapter six of the constitution.

“DPP has made several applications to withdraw prosecution of several active cases in court, including graft-related cases, based on insufficient evidence to sustain a prosecution,” said Sheila Masinde, Executive Director of Transparency International.

This is despite the law requiring that DPP does not initiate prosecutions until and unless he is convinced that the evidence available is admissible and sufficient.

The groups assert that Haji’s incompetence resulted in the dismissal of approximately seven graft-related cases involving senior government officials, costing the taxpayers an estimated Ksh.11 billion at a time when the country is facing significant financial challenges.

Katherine Cherotich, a private citizen from Nakuru County. Has also petitioned the court to prevent the planned vetting and subsequent appointment of Haji as NIS Director General. Because he violated the constitution by withdrawing cases involving senior government officials. Failing to order investigations into cases of extrajudicial killings, and eroding the independence of the office of the DPP.

In response to claims of case withdrawal. Haji argued that he has the legal right to withdraw any case where he believes there is insufficient evidence.

“I have become unanimous with withdrawals, but withdrawals are provided by the constitution and are a right, and where there is a miscarriage of justice, that withdrawal must apply regardless of who that person is in society,” said Haji.

During the launch of the complaints and case review system at Nairobi Remand Prison in the Industrial Area. The DPP gave a speech.

The online system is intended to make it easier for anyone to file a complaint or review their case. As well as contribute to the decongestion of the nation’s prisons.
