High Court Temporarily Suspends Presidential Task Force on Public Debt Audit

The high court has temporarily halted the Presidential task force on the forensic audit of public debt.

On Monday, July 8, Justice Mugambi issued the suspension following a petition by Nakuru-based doctor, Magare Gikenyi.

The order partially stated, “Pending the hearing and determination of this Application, a conservatory order is issued suspending Executive Order No. 4 and/or Gazette Notice No. 8261 Vol. CXXVI-No 97 dated 5th July 2024, establishing the presidential task force on forensic audit of public debt.”

Justice Mugambi also prohibited task force members from performing any duties until the petition is resolved.

The judge stated, “Pending the hearing and determination of this application, an interim order is issued prohibiting the Respondents, or anyone acting on their behalf, from performing any functions related to Executive Order No. 4 and/or Gazette Notice No. 6261 Vol. CXXVI-No. 97 dated 5th July 2024, establishing the Presidential task force on the forensic audit of public debt.”

On Friday, July 5, President William Ruto established the Presidential Task Force to conduct a forensic audit of public debt.

Ruto appointed Nancy Onyango as the chairperson, with Luis Franceschi as her assistant.

The task force includes Philip Kaikai, LSK President Faith Odhiambo, Institute of Engineers of Kenya President Shammah Kiteme, and Vincent Kimosop, with Abraham Rugo and Aaron Thegeya serving as joint secretaries.

However, Odhiambo rejected the appointment, claiming that the task force’s establishment by President Ruto was unconstitutional.

LSK stated, “It is our considered view that the establishment of the task force is unconstitutional. The mandate to audit public debt rests with the office of the Auditor-General.”
