    High Court: IG Koome Must Produce Maina Njenga, No Arrest Unless Bail Jumped

    The High Court has ordered Inspector General of Police Japhet Koome to release former Mungiki leader Maina Njenga Kamunya and two other individuals on KSh 100,000 cash parole.

    Application for Habeas Corpus by Maina Njenga

    The directive was issued by Justice Diana Mochache in response to a Habeas Corpus petition lodged by the eldest son of politician Maina Stephen Njenga. The court further ordered the police not to arrest or detain the three defendants unless they fail to appear in court on July 24, 2023.

    Justice Mochache ordered the respondents, their agents, or anyone in custody of the applicants to release them upon payment of cash bond.

    Maina Stephen Njenga filed an urgent application on Thursday, July 20 to compel the police to produce his father, who was allegedly kidnapped by unknown individuals in government vehicles on Wednesday, July 19 night.

    While he was visiting his ailing father in the Kiserian region, he was apprehended.

    Maina Njenga’s son defends arrested parent

    “Maina Stephen Njenga, the undersigned herein, as the eldest son of Maina Njenga Kamunya, hereby authorizes Ndisi Munje and Associates Advocates to file the necessary proceedings to protect Maina Njenga Kamunya’s interests. Peter Njoroge Kamunya and Felix Lekishe,” the court documents read.

    Stephen Njenga told the court in his application that his father was unwell and on medication at the time of his arrest.

    Maina, through his attorney Indisi Munje, exonerated his father of any involvement with Azimio la Umoja One Kenya Alliance protests and reiterated that his father’s arrest was unlawful.

    Unlawful subversion of the Kenyan constitution

    This occurred a few hours after the court released Embakasi East Member of Parliament Babu Owino on bail after he pleaded not guilty to allegations of engaging in subversive activities.

    There was excitement at the courthouse when police officers seized on the legislator as he and his attorneys approached the bail processing area.

    The Senior Counsel Bar Association condemned the action, characterizing it as an abuse of the court.
