High Court Halts Itumbi’s Case Against State: Unexpected Turn of Events

ICT Chief Administrative Secretary (CAS) Dennis Itumbi had filed a lawsuit against the state about the La Mada assassination case. The high court has withdrawn the lawsuit.
Itumbi, through his attorney Majimbo, informed the court that the criminal case before the lower court had been withdrawn, so it would be appropriate to withdraw the case before the high court.

“There have been developments; the OPDD withdrew the case before the chief magistrate; since the current petition was based on that suit, it is only proper that the petition before you be withdrawn, and we will ask that the case be marked as withdrawn by the petitioners,” explained attorney Georgiannis Majimbo.

The Attorney General and Director of Public Prosecution did not object to the application.

A court in Nairobi exonerated Itumbi and his co-accused Samuel Gateri of the criminal charges last week. The court determined that the statute under which the two defendants were charged was unconstitutional.

“It is extremely unfortunate that I am acquitting the accused after the trial. However, the law permits me to acquit the defendant if it turns out that the provision under which they were charged was unconstitutional. Magistrate Shitubi ruled, “I will proceed to acquit the two defendants under section 87(b) of the Criminal Procedure Code.”

The two were on trial for allegedly forging a letter alleging that a senior government official in the administration of former President Uhuru Kenyatta had hatched a plot to eliminate the then-Vice President, who is now the Head of State.

The alleged assassination attempt took place at the La Mada Hotel.
