Ex-Mungiki Chief Urges Summoning of Deputy President for Contempt Allegations

Former Mungiki leader Maina Njenga wants Deputy President Rigathi Gachagua to appear in court over allegations of contempt of court.

Tuesday, the former leader of the outlawed criminal organization appeared before a Nakuru court. Where he accused Mr. Gachagua of making public comments about a case in which he faces multiple charges. Including membership in an organized criminal organization.

“This court has a responsibility to protect the sanctity of trials and proceedings before it. The general rule of the law prohibits comments that constitute sub judice. “Only the court should discuss the case’s facts,” court documents state.

In his petitions to the court, Njenga argued that Gachagua’s remarks about him constitute contempt because the case is still pending.

“This is punishable by the court where such a precedent exists. In this case, I have been asked to summon the Deputy President of the Republic of Kenya, who is accused of making statements that are prejudicial to the case,” the judge said.

The court denied Njenga’s petitions, stating that there was insufficient evidence that a violation had occurred.

“No evidence has been presented to demonstrate the deputy president’s alleged contempt,” the court stated.

Njenga was previously questioned regarding allegations that on 11 May 2023, he addressed a gathering in the Wanyororo area of Nakuru County to “encourage support” for the outlawed criminal organization Mungiki.

He is additionally accused of engaging in criminal activity. He is accused of inviting individuals to the aforementioned meeting in the Wanyororo region, where he is alleged to have communicated Mungiki-related instructions.

In addition, he is accused of possessing “a military backpack strap, property of the National Police Service (NPS), that is suspected to have been stolen or unlawfully obtained.”
