EACC’s Land Recovery Efforts in Upper Hill
On Sunday, May 14, the Ethics and Anti-Corruption Commission (EACC) disclosed plans to recover public land belonging to Kathi’s Court in Upper Hill, Nairobi.
Peter Maundu, a former member of parliament for Makueni and assistant minister of agriculture, sold the land to a private developer, according to land records.
EACC stated in a statement that it had filed a lawsuit to recover the property currently housing the Kadhi Court in Nairobi.
“The EACC has filed a lawsuit to recover the property. Currently housing the Nairobi Kadhi’s Court in Upper Hill from squatters. Former Commissioner of Lands Wilson Gachanja fraudulently allocated the property. To former Makueni MP and Agriculture Assistant Minister Peter Maundu,” EACC tweeted.
In the recovery suit filed on 11 May 2023, Wilson Gachanja was sued in his capacity for facilitating the theft of Kadhi’s Court-owned public land.
Simultaneously, EACC sought orders compelling the former representative to pay general damages for fraud and breach of fiduciary duty.
Although the Judiciary was in actual possession of and utilizing the Kadhi’s Court. The property was fraudulently acquired by a private company.
The commission’s intention to recover Kadhi’s court land in Nairobi. Was revealed less than a week after the EACC recovered prime property in Nyali, Mombasa. Valued at Ksh52 million, following a lengthy dispute between a couple and the government.

According to a statement issued by the EACC on Thursday, May 11th. The couple acquired the prime parcel of land through fraud.
This occurred after Lady Justice Nelly Matheka of the Mombasa Environment and Land Court. Ruled that the Kenya Civil Aviation Authority (KCAA) had unlawfully acquired the parcel of land.
It was determined that a Ministry of Lands official assisted the couple in purchasing the bungalow in Nyali, Mombasa County.
In addition to the 4-bedroom bungalow, a servant’s quarter was constructed on the parcel of land.
EACC expressed concern over the frequency with which Land Ministry officials assisted cartels in land-grabbing cases. And warned that no one would be spared in the country’s fight against corruption.
The most recent efforts by EACC to recover stolen property. Occurred days after Ex-CITAM presiding Bishop David Oginde took the oath of office. As the Commission’s new chairman on Tuesday, May 9.
Oginde replaced retired Anglican Archbishop Eliud Wabukala, who had served as EACC director for the previous six years.
