DPP Clears Matiang’i of Charges Due to Insufficient Evidence
Former Interior Cabinet Secretary, Fred Matiang’i, and his lawyer, Danstan Omari, will not be facing charges in court over allegations of publishing false information regarding a police raid at Matiang’i’s Karen home on February 8.
The Office of the Director of Public Prosecution (ODPP) has stated that the evidence provided by the Directorate of Criminal Investigations (DCI) is insufficient to sustain the charges.
In a press release, the ODPP stated that after an independent and thorough analysis of the evidence and witness statements provided, the evidence did not meet the requirements to prove the allegations of conspiracy to commit a felony and publication of false information as required by law.

Consequently, the ODPP directed the DCI to close the inquiry file with no further police action.
The DCI had previously forwarded the file to the ODPP to recommend the prosecution of Matiang’i and Omari for the alleged offenses.
The allegations related to a police raid that was said to have occurred at Matiang’i’s home in Karen, Nairobi, on February 8. However, the ODPP has found that the evidence provided did not meet the ingredients needed to prove the charges against the two.
This decision by the ODPP means that Matiang’i and Omari will not be facing any charges in court over the allegations.
The case had generated a lot of public interest, with many speculating on the motives behind the alleged police raid at Matiang’i’s home.
However, the ODPP’s decision brings an end to the case, and Matiang’i and Omari can now move on from the allegations.
It is worth noting that the decision by the ODPP is based on the evidence and witness statements provided to them.
New evidence may emerge in the future that could lead to the case being reopened.
Nonetheless, for now, Matiang’i and Omari are free from any charges related to the alleged police raid at Matiang’i’s home.
