    Diplomat Sues Saboti MP Amisi for Ksh.7M Loan Dispute

    Diplomat Sues Saboti MP Amisi for Ksh.7M Loan Dispute

    A petition has been lodged against Caleb Amisi, the Member of Parliament for Saboti, accusing him of not reimbursing “soft loans” totaling $60,300 (approximately Ksh.7.9 million) borrowed from a diplomat.

    Diplomat Josphat Machogu asserts that he initially encountered Amisi around June 2021 during an official visit by Amisi and fellow Members of Parliament to the IGAD offices in Djibouti. Following this encounter, they developed a friendship, exchanged contact information, and maintained communication thereafter.

    Machogu, represented by his attorney Daniel Achach, alleges that Amisi approached him multiple times between January 2022 and September 2022, seeking various amounts of money as loans.

    According to court documents obtained by Citizen Digital, Amisi received an initial sum of Ksh.500,000, which was allegedly transferred directly to his account around January 6, 2022.

    Around April 12, 2022, the diplomat claimed to have transferred an extra amount of $50,000 (equivalent to about Ksh. 6 million) to the accused.

    Later in September, the petitioner says Amisi requested another soft loan “to enable him offset some unforeseen bills resulted from the campaigns.” The defendant says he advanced to Amisi an additional USD 10,300 (approx.Ksh.1.3 million).

    However, the diplomat contends that the Member of Parliament returned Ksh.500,000 after his threat of initiating legal proceedings.

    โ€œThe plaintiff prays for judgment against the Defendant for USD 60,300.00 and interest at court rates from the date of filing this suit until payment in full.โ€ reads court papers.

    He asserts that the Member of Parliament informed him about his intention to campaign for the General Election later in the year to reclaim his National Assembly seat. He mentioned facing difficulties in gathering sufficient funds through donations and fundraising efforts, thus requiring a refundable soft loan.

    He additionally asserts that they believed that once elected and inaugurated, the legislator would settle all the flexible loans given to them in a single payment.

    โ€œIn the alternative, Defendant expressed to Plaintiff that should he not win in the elections, he would give Plaintiff a payment proposal that would be acceptable, but Defendant was almost very sure of a win with Plaintiff’s soft loan,โ€ reads the court papers.

    The diplomat claims that although the Plaintiff fulfilled their obligations under the agreement, the Member of Parliament purportedly hasn’t reimbursed the soft loans provided to him by the Plaintiff.

    โ€œI continue to suffer loss and damagesโ€ฆ Plaintiff made several attempts to reach out to Defendant for the payment but Defendant became evasive, slippery, and also for a long period, and when he finally did, Defendant became abusive and threatening to Plaintiff,โ€ claims the diplomat.

    The diplomat alleges that the Member of Parliament warned him of severe repercussions if he persisted in requesting repayment of the loan, even going as far as mentioning the term ‘Kitakuramba’ to the plaintiff.
