Appeals court delivers win to Dubai firm seeking to freeze Anne Amadi’s bank accounts

Following an alleged gold export fraud, the Court of Appeal has permitted a Dubai-based company to challenge a decision to unfreeze the bank accounts of Judicial Registrar Anne Amadi, her son Brian, and two others.

Police investigations, according to Bruton Gold Trading LLC, indicate that Ms. Amadi received a portion of the funds she was allegedly defrauded of, and the company wants the Court of Appeal to impose new restraining orders on the named bank accounts.

The judge deemed the case to be an emergency and ordered the parties to await the formation of the three-judge tribunal that will hear the appeal.

Bruton asserts that the bank account he transferred money to is associated with Amadi & Associates Advocates and was opened by Ms. Amadi after she joined the Judiciary.

Brian Amadi, Andrew Njenga Kiarie, and Daniel Mureithi withdrew the Sh91 million that Bruton had deposited into the company’s account in cash.

Bruton also desires the suspension of the High Court case it filed seeking Justice Alfred Mabeya’s disqualification.

The Dubai firm asserts that Justice Mabeya is biased and issued a definitive order because she exonerated Ms. Amadi and her son before the conclusion of the case.

It desires that a separate High Court judge hear the case. Bruton argues that proper procedure was not followed when Mrs. Amadi, her son, and Mr. Kiarie requested that their accounts be unfrozen.

Although the applications were not certified as urgent, which is a legal requirement, Justice Mabeya heard them and decided to unfreeze their accounts.

Bruton also claims that the documents it submitted on May 17, 2023, were inexplicably deleted from the judiciary’s e-filing portal, and were only reinstated on May 29, 2023, after its attorneys physically went to the Milimani High Court to complain.

The Dubai company asserts that someone at the top of the Judiciary’s food chain is interfering with the High Court case it has filed, and it suspects that Ms. Amadi is using her influence to obtain a favorable outcome.
