Acting Inspector General of Police Dodges Court Again: Masengeli’s Excuse? A ‘Workshop’ in Mombasa!
Acting Inspector General of Police Gilbert Masengeli did not show up in court as scheduled for allegations related to disregarding court orders.
The court was informed that Masengeli was attending a workshop in Mombasa, which prevented his appearance.
This marks the third instance where Masengeli has missed a court appearance as mandated.
The court sought his presence to address why he should not be held in contempt of court concerning a missing persons case.
Justice Lawrence Mugambi indicated on Tuesday that Masengeli would be allowed to explain himself before any consequences for ignoring court orders are decided.
Mugambi stated, “The court must uphold its authority in enforcing the rule of law where deliberate disobedience of its orders is evident. Nevertheless, this power must be exercised with extreme caution.”
The court anticipated Masengeli’s appearance on Tuesday for questioning about the recent disappearance of three individuals in Kitengela, but he was absent.
His legal team informed the judge that he was engaged in official duties outside the office.
However, Faith Odhiambo, head of the Law Society of Kenya (LSK), argued that Masengeli remained in contempt after being summoned to court.
“They show no intention to comply with court orders. These so-called official duties are not more critical than human lives,” she asserted.

Odhiambo also pointed out that Masengeli had not provided proof of his absence from town.
She requested that an arrest warrant be issued against him.
“He has shown disregard for the court by neglecting the Bill of Rights. The petitioners’ families are deeply distressed by the lack of information about their loved ones,” she continued.
Judge Mugambi concurred with the LSK, affirming that everyone is entitled to their rights and fundamental freedoms.
He emphasized that it is the state’s responsibility to safeguard these rights and freedoms.
“This country is governed by the rule of law, not by individuals’ whims. The court has the authority to enforce its orders, and those who deliberately flout them must be prepared to face the repercussions,” the Judge remarked.
Nevertheless, he allowed Masengeli the opportunity to defend himself before taking any further actions.
