    Public Service CS Moses Kuria Sued Over Introduction of Judiciary Services at Huduma Centres

    On Sunday, Moses Kuria, the Cabinet Secretary for Public Service, alleged that the Law Society of Kenya (LSK) had misconstrued the autonomy of the Judiciary.

    Kuria addressed the High Court following a legal challenge for implementing Judiciary services across all Huduma Centers.

    “Dear LSK. You are misinterpreting the independence of the Judiciary. What’s wrong with citizens using Huduma Centres to access Judiciary Services?” he posed.

    The Civil Service underscored that services were provided to Kenyans at Huduma Centres without any form of discrimination.

    Kuria emphasized his commitment, along with Chief Justice Martha Koome, to transform the accessibility of Judiciary Services through the innovative approach of the Huduma initiative.

    He was one of six individuals facing a lawsuit filed by advocate Carolyne Kamende. She contended that the decision to implement services at Huduma Centers posed a risk to the autonomy of the Judiciary.

    She filed a lawsuit against CJ Koome, the Chief Registrar of the Judiciary, Attorney General Justin Muturi, and the Chief Executive Officer at Huduma Kenya.

    In the legal case submitted, LSK was identified as a concerned party, prompting a reaction from CS Kuria.

    “The Law Society of Keny was not consulted before the Judiciary decided to transfer some of the judicial services to judiciary desks to be domiciled at Huduma Centres,” read part of the petition.

    Kamende stated that the action violated the Constitution, particularly the section requiring all public officials to engage in public participation during the formulation and execution of public policy decisions.

    She mentioned that should it be put into practice, Kenyans pretending to be advocates would have a means to unlawfully provide services to unsuspecting individuals in Kenya.

    The issue will be brought up on March 18, 2024.

    At the same time, the Ministry declared that operations would begin nationwide at Huduma Centres on Monday, January 29.

    A range of services will be provided, such as filing civil cases, conducting inquiries, submitting documents for ongoing cases, and processing payments for fines and deposits, among other offerings.
