Wetang’ula Stares at Jail as Court Set to Rule on Explosive Majority Party Battle on March 21
The Court of Appeal will give its decision on March 21 on whether to put on hold the High Courtโs ruling, which declared the Azimio coalition as the majority party in the National Assembly.
Speaker Moses Wetangโula, through his lawyer Elisha Ongoya, argues that the High Court made a mistake in overturning his ruling on the majority party without thoroughly reviewing the evidence.
He insists that post-election coalitions can alter the Independent Electoral and Boundaries Commissionโs (IEBC) declaration and questions the validity of the Azimio coalition agreement, noting that it does not include the signatures of officials from UDM and MDG.
Wetangโula warns that if the High Courtโs ruling is not put on hold, he could face contempt of court charges, which might lead to his imprisonment and disrupt parliamentary activities.
On the other hand, Kibe Mungai, the lawyer representing the petitioner, argues that the High Courtโs decision should not be overturned because Wetangโulaโs ruling violated the law.

Mungai maintains that Azimio remains the rightful majority party and that suspending the High Courtโs decision would be an act of judicial lawlessness.
He accuses Wetangโula of creating confusion in Parliament and labels his appeal as a misuse of the legal process.
Earlier, the High Court had reversed Wetangโulaโs ruling that named Kenya Kwanza as the majority party, affirming that Azimio should hold that position.
Despite this, Wetangโula still declared Kenya Kwanza the majority, stating that it had 165 members compared to Azimioโs 154, and directed that an appeal be filed.
Following this decision, Azimio MPs walked out of Parliament in protest, promising to take further action.
