Wahome Sparks Uproar with Hike in Land Transaction Fees

Land transaction fees have been proposed to increase by the Ministry of Lands. This could hurt Kenyans, who are already struggling with a rising cost of living and increased taxes.

The amendments to the law proposed by Lands Cabinet Secretary Alice Wahome would increase certain land levies that have remained unchanged for several decades.

”The main objective of the proposed statutory instruments is to amend the existing state instruments that have not been updated for a long time, especially in respect of fees prescribed for various services rendered by the Government in the land sector,” the CS stated.

The revised cost for an official land inquiry is Ksh 2,000, in addition to Ksh 1,500 for document registration and a corporation of certificates fee.

Additionally, the fee for trust incorporation has been increased by the ministry from Ksh 5,000 to Ksh 50,000.

The revision of the application fee for certified copies of the proceedings resulting from the land registrar’s determination to Ksh 3000 for the initial ten pages was included in her proposals. An additional page will incur a fee of Ksh 100 from potential applicants.

Resubmission of any document for registration will incur a fee of Ksh 1,500, whereas a name correction not completed by the registrar will incur a fee of Ksh 2,500. The fee to revoke a power of attorney is Ksh 5,000.

The fee for confirming boundary disputes has increased to Ksh 5,000, in addition to the Ksh 5,000 charge for resolving boundaries. The cost to install a caution is Ksh 3,000.

Transport and a day spent away from the office providing registry advice will each cost Kenyans Ksh 5,000 for a land registry representative.

The ministry asserts that the revisions have been completed because significant updates have not been made in over three decades.

The aforementioned proposals are in response to the government’s recent haste to raise taxes and fees for essential services.

The Ministry of the Interior recently published a list of revised fees for a variety of government services, including passport acquisition, citizenship replacement, and ID replacement.
