Uhuru Facing Lawsuit Over Jubilee National Delegates Conference Remarks
Hassan Osman, a former nominated member of parliament, filed a lawsuit against former President Uhuru Kenyatta on Monday, May 8, alleging that the National Delegates Conference (NDC) scheduled for May 22 was illegal.
According to court documents obtained by GossipA2Z, the former nominated member of parliament alleged that Uhuru violated the Constitution by calling the NDC.
The lawsuit, which was filed with a certificate of urgency, asserted that the special delegates convention called by Uhuru was also improper and illegal.
The Jubilee Party, its secretary general, Jeremiah Kioni, and its treasurer, Kagwe Gichohi, were also named as defendants in addition to Uhuru.
Osman requested, among other things, that the court prevent the NDC from occurring.
“THAT this Honorable Tribunal does grant Temporary orders and/or restraining and conservatory orders restraining the Respondents either by themselves, their agents, servants, employees, or any other person or any member of Jubilee Party from convening any meeting of the Special Delegates Convention or any other day and/or dealing, acting or undertaking in any way whatsoever and/or discussing and/or effecting changes in the National Executive Committee,” the document stated.
The documents allege that Uhuru violated four statutory rights.
These were the;
a) Failure to comply with the provisions of the Kenyan Constitution
b) Not adhering to the provisions outlined in the party’s constitution
c) Failure to comply with the provisions of Act No. 11 of 2011 on Political Parties

d) Failing to act fairly and justly under the circumstances
Uhuru issued a 21-day notice on April 30 to the Jubilee party members of the special NDC to formulate new policies, receive a status report from the National Executive Committee (NEC), and consider and approve any other matters that may arise.
Osman stated in his affidavit that the Jubilee Party was split into two factions, one led by Uhuru-Kioni and the other by nominated MP Sabina Chege and his East Africa Legislative Assembly (EALA) colleague Kani Kega.
He added that Kega had sent a letter to the Registrar of Political Parties. Requesting various documents to establish party leadership.
In light of the ongoing leadership disputes. The representative argued that it would be prudent to postpone the NDC until the situation is resolved.
Before the NDC, Osman also demanded the publication of the Jubilee Party membership register. The minutes of the previous NDC, and the records of fund disbursements for the fiscal years 2021/22 and 2022/23.
Uhuru appeared at the Jubilee headquarters in Kileleshwa, Nairobi, on April 26. After the Kioni and Kega factions attempted to seize control of the party.
“Anyone who desires to leave a party is free to join another. We have no disagreements with anybody. We wish to protect our party, and those who do not wish to do so are free to leave,” Uhuru stated.
Later, he contacted the registrar to have Kega and Chege removed as party members. Sabina Chege was in charge of their plot to remove him from his position as party leader.
