TSC Fires 73 Teachers Over Disciplinary Issues

The Teachers Service Commission (TSC) has terminated 73 educators due to multiple disciplinary cases against them.

The CEO of the teachers’ employer, Nancy Macharia, published the names, TSC numbers, disciplinary case numbers, and dates of dismissal in a Gazette Notice on Friday.

She stated that those on the list will no longer serve as instructors as of the date of removal. Out of the 73, 10 instructors fired were also removed from the Board of Management (BOM).

According to the TSC, instructors are prohibited from providing instruction unless they are registered under the Instructors Act. 

According to the Code of Regulations for Teachers, this means that they cannot teach or assist in teaching in any school.

“A person shall not engage in the teaching service unless such a person is registered as a teacher under this Act,” reads part of the Act.

“Where the name of any teacher is removed from the register under this Act, such name shall not be reinstated except by direction of the Commission.”

Macharia cautioned schools against employing unregistered teachers, failing which they will be culpable of an offense and face a fine of at least Ksh100,000 or two years in prison, or both.

According to TSC, the Commission may terminate a teacher’s appointment by providing one month’s written notice or by paying one month’s basic remuneration instead of the notice.

Permanent and pensionable appointments may be terminated by the commission, which must provide a three-month written notice or pay one month’s salary instead of the notice.

In instances of temporary employment, National Social Security Fund (NSSF) benefits are administered by Cap 258 of the NSSF Act.

A male educator who contributed to the Widows and Children’s Pension Scheme (WCPS) is eligible to receive a refund of the contributions made.
