Lands Cabinet Secretary Alice Wahome has ordered all foreigners in Kilifi County to return their illegal freehold title deeds to the government.

On Thursday, December 19, at the Muyeye Health Centre in Malindi, the CS expressed concern about the growing issue of foreigners holding freehold title deeds, which is illegal.

“We have no issues with foreigners who have lived here for an extended period,” the CS remarked during the unveiling of the Ksh48.8 million maternity wing built by the State Department for Housing and Urban Development.

“However, some dishonest individuals have misled them, issuing freehold titles. Foreigners cannot own freehold titles unless they are Kenyan citizens.”

The CS clarified that the 2010 constitution allows foreigners to only receive leases for up to 99 years.

She also called on Kilifi Governor Gideon Mung’aro to ensure that foreigners with freehold titles are prevented from engaging in transactions involving freehold properties at land registries.

As outlined in Article 65 of the 2010 Kenyan constitution, freehold property refers to land that is “free from hold,” meaning no holding charges are due. When a person purchases a freehold property, the ownership is entirely transferred to them, with the initial payment covering all costs.

Once a Kenyan acquires freehold property, they have full rights to use or alter it, provided they adhere to local community regulations.

Additionally, CS Wahome announced that the Ministry had partnered with the Kilifi county government to establish a land registry in Malindi, which will serve residents of Malindi and Magarini Sub Counties. Previously, these residents had to travel to Kilifi for land-related services.

The issue of foreigners possessing freehold title deeds has become widespread along the coast, with many falling prey to unscrupulous dealers due to their lack of familiarity with Kenyan laws.

To combat land cartels exploiting foreigners, the Ministry revealed plans to digitize all land operations and applications in July.

Financial institutions are also being urged to ensure their land valuers and lawyers conduct thorough due diligence when verifying land titles.

The CS declined, which led to an escalation of the conflict. Reports indicate the clash was so severe that it resulted in the dismantling of the public address system.

In response to the incident, Kilifi Governor Mungaro expressed his dissatisfaction, condemning the violence he attributes to political motives. He urged Jumwa to postpone her political ambitions until the 2027 elections.

“Regardless of your previous or current position, we should respect one another and wait for the 2027 elections,” stated Governor Mungaro.

Critics have accused Jumwa of having ignored the community during her tenure as Cabinet Secretary and now seeking recognition following her dismissal.

Jumwa and Mungaro were rivals in the 2022 general elections, both contesting for the Kilifi gubernatorial seat, which Mungaro ultimately won.

Mungaro, representing ODM, secured 143,773 votes, while Jumwa received 65,893 votes.

A former KEPHIS employee has been slapped with a Ksh5 million fine or an eight-year prison sentence by Nairobi’s Anti-Corruption Court.

The judgment, issued on August 20, concludes a case that highlighted a serious breach of public trust.

The ex-Assistant Inspector II was found guilty of using fraudulently obtained academic certificates to gain employment at KEPHIS.

It emerged in court that the accused falsely claimed qualifications from Baraka Agricultural College and Kilifi Institute of Agriculture, information that was later debunked as fabricated.

Chief Magistrate Thomas Nzyoki imposed a fine of Ksh100,000 or a 12-month jail term for fraudulently acquiring academic certificates.

Additionally, the Court mandated a fine of Ksh4.7 million—the total earnings during the employee’s tenure at KEPHIS—or a five-year imprisonment if unpaid.

The fraudulent conduct spanned from June 2013 to April 2021, during which the employee collected a salary based on fake documents.

Prosecutor Susan Keli established that KEPHIS was misled into believing the employee was qualified, resulting in illicit public fund misappropriation.

Besides the primary fraud conviction, the former employee was also found guilty on two counts of submitting false information to a public entity, each with a fine of Ksh200,000 or a two-year sentence.

These charges stemmed from the false claims on the employment form, where the employee asserted holding a Diploma in Sustainable Agriculture and Rural Development and a Certificate in Agriculture with Distinction—both of which were fictitious.

The EACC launched an investigation after KEPHIS’s Managing Director raised concerns on June 8, 2021, questioning the legitimacy of the employee’s academic credentials.

The investigation uncovered that the employee forged both a Diploma in Sustainable Agriculture and a Certificate from the Kilifi Institute of Agriculture, alongside a fake KCSE certificate with a C grade.

These forgeries enabled him to secure a position at KEPHIS, earning over Ksh4.7 million through the years.

Following the EACC’s inquiry, the ODPP approved the employee’s arrest on 12 charges, including fraudulent fund acquisition, forgery, and submitting false information.

Formal charges were filed at the Anti-Corruption Court in Milimani on May 25, 2023.

During the trial, evidence revealed that the employee knowingly submitted false qualifications in his KEPHIS job application on February 8, 2013.

These fabrications were solely aimed at securing the role.

While the employee was acquitted of four forgery charges due to gaps in evidence, he was convicted on all remaining counts of fraud and false information submission.

The sentences are to be served consecutively, starting from July 30, 2024.

The Embu High Court has issued a temporary order halting the ban on Muguka in Mombasa and Kilifi counties.

On Tuesday, May 28, Justice Lucy Njuguna stated she was convinced by an application submitted by the Embu County Assembly and the Kutheremeka Muguka Sacco Society Limited.

“Pending the interpartes hearing and determination of this application, a conservatory order is hereby granted to restrain and/or stop the Respondents and their agents from implementing Executive Order No. 1 issued on May 22, 2024, by the 1st Respondent and the 2nd and 3rd Respondents until July 8, 2024, when the application will be heard interpartes,” Justice Njuguna directed.

The High Court judge also mandated that the application be served to the respondents within seven days.

This court order follows a meeting between President William Ruto and the leadership of Embu County regarding the ban on Muguka in coastal counties.

Agriculture and Livestock Cabinet Secretary Mithika Linturi, who attended the meeting, noted that Muguka, a type of Miraa, is classified as a scheduled crop under the Crops Act 2013 and the Miraa Regulations 2023.

“Given that Muguka is recognized by national legislation, any other laws or orders that contradict national legislation are null and void. The Crops Act 2013 and the Miraa Regulations 2023 were passed by the National Assembly and the Senate with the Council of Governors’ agreement,” read a statement from the State House.

President Ruto instructed CS Linturi to organize a consultative forum with all stakeholders to address the raised concerns and reach an agreement on the implementation of the Miraa/Muguka Regulations 2023.

Governors Abdulswamad Sheriff Nassir (Mombasa) and Gideon Mung’aro (Kilifi) prohibited the entry, transportation, sale, and use of Muguka in their respective counties last week.

Police in Kilifi are currently investigating a tragic incident involving the death of a man while he was spending time with his female partner.

Bernard Omayo, aged thirty, had gone to visit Cecilia Chepkirui at her residence in Mbarakani on the evening of Wednesday, May 22.

The evening took a tragic turn during their intimate encounter.

According to the authorities, the unfortunate event occurred when Omayo choked on his saliva and subsequently passed away while being transported to the hospital.

A police report obtained by Gossipa2z.com revealed that Omayo collapsed during their sexual activity due to choking on saliva. Chepkirui sought help from her neighbors and rushed him to Kilifi County Hospital, where he was pronounced dead upon arrival.

Omayo’s body was then taken to the morgue at Kilifi County Hospital for further examination through an autopsy.

David Kiplangat, aged sixty and an assistant pastor at an SDA church in Ketitui, was discovered deceased by the woman accompanying him. She promptly notified the management of the hotel in Kapsoit, Kericho, before leaving the premises.

Upon investigation, authorities found a used contraceptive at the scene.

The deceased’s body was then transported to the mortuary at Kericho County Referral Hospital as investigators began efforts to locate the woman involved in the incident.

Kilifi Governor Gideon Mung’aro took action on Friday by instituting a ban on Muguka, which includes its transport, distribution, and sale.

In an official statement, the governor mandated the immediate closure of all outlets within Kilifi County, whether they are involved in retail or wholesale, that are engaged in selling or distributing Muguka.

Additionally, Mung’aro specified that vehicles carrying Muguka will not be permitted to enter Kilifi County.

The governor formally announced “Executive Order No. 1 of 2024,” which prohibits the entry, transport, distribution, sale, and use of Muguka within Kilifi County. This order is issued under the authority granted by Section 30(2)(1) of the County Government Act and other pertinent laws of Kenya.

In response to this ban, county departments and their agencies were instructed to rigorously enforce the order and ensure strict adherence.

To ensure comprehensive enforcement of the ban, the governor immediately directed all Kilifi County enforcement officers, under the Directorate of Enforcement, to implement the order without exceptions.

Moreover, the governor emphasized that any officer caught colluding with offenders will face legal consequences and disciplinary measures.

This decision by Mung’aro comes shortly after Mombasa Governor Abdulswamad Sheriff Nassir announced a similar ban on Muguka.

In a notice dated May 22, Nassir ordered all outlets, encompassing both retail and wholesale establishments, selling Muguka in Mombasa County to cease operations promptly.

The governor instructed County Departments responsible for law enforcement to apprehend individuals who violate the ban.

Governor Nassir invoked his authority vested by the Constitution and existing laws to issue a comprehensive prohibition on the entry, transport, distribution, sale, and use of Muguka and its derivatives within Mombasa County.

Explaining the rationale behind the decision, Governor Nassir stated that despite attempts to engage with those involved in the trade, they remained non-compliant. Consequently, legal consultation affirmed the validity of the ban, leading to the issuance of an executive order to enforce it effectively.

A court in Mombasa has ordered the remand of the controversial preacher Paul Makenzie and his co-suspects, who are linked to the Shakahola cult that massacred over 400 people.

On Thursday, the accused appeared before the Shanzu law courts, where the court ordered that they be detained for an additional week and ordered that they return on October 19 for further instructions.

The court will then determine whether or not to detain the 27 defendants for six months while investigations into the deadly cult continue.

On behalf of the suspects, attorney Wycliffe Makasembo opposed detention, arguing that the accused’s continued detention violates their rights as suspects.

In the meantime, the prosecution, represented by Assistant Director of Public Prosecutions (DPP) Jami, informed the court that the request for additional detention was warranted due to the seriousness of the case.

The suspects face multiple allegations, including terrorism, murder, suicide counseling, and suicide assistance, in addition to abduction, radicalization, genocide, crimes against humanity, child cruelty, fraud, and money laundering.

Pastor Ezekiel Odero obtained a minor victory when the court halted the deregistration of his Newlife Prayer Centre Church, allowing him to temporarily recommence operations.

The outspoken clergyman had petitioned the High Court to prevent the Registrar of Societies from enforcing the directive.

In his ruling, Justice Jairus Ngaah halted the deregistration process so that the defendants could submit arguments regarding the gazette notice.

The pastor is expected to provide evidence regarding whether the Registrar of Societies complied with the law during the deregistration procedure.

Pastor, through his attorney Danstan Omari, petitioned the court to overturn the registrar’s directive declaring the church’s deregistration unlawful.

His legal team argued that the church had filed tax returns promptly.

“The gazette notice issued by (Registrar of Societies) purported that the cancellation of the applicant’s church was effected on May 19, 2023, even though on May 25, 2023, the applicants learned via the media in a letter dated April 27, 2023, requiring the Applicants to show cause within 21 days, why his church’s registration should not be canceled for failure to file its annual returns,” the statement stated in part.

“In an obvious scheme to frustrate and obstruct the Applicants’ church operations, the Applicants learned of the notice to show cause through the media eight days after the 21-day notice had expired.”

Friday, the state deregistered the church in question as part of a crackdown on religious institutions.

The helicopter of Christ Church, Theophilus Church, Kings Outreach Church, and Goodnews International Ministries were also deregistered.

In April, the pastor was detained and arraigned in court on charges of conspiracy to commit crime and money laundering, although he was not formally charged.

Pastor Ezekiel was released on bail on May 12 after refuting all charges against him and has maintained his innocence since then.

Exhumations carried out by police officials in Shakahola forest have turned up ten additional bodies from the mass graves in Kilifi County where it is claimed that victims of a cult are buried.

Since Monday, when the fourth and last part of the exhumation began, this takes the total number of people who have died as a result of the starvation cult to 360, as stated by the Coast Regional Commissioner Rhoda Onyancha.

According to Regional Commissioner Onyancha, there have been no more arrests made about the deaths; as a result, the total number of arrests has remained the same at 37.

She also mentioned that the number of people who have been rescued up to this point is still 95, while the total number of DNA samples taken is 253.

On Monday, the Secretary of the Interior Cabinet, Professor Kithure Kindiki, stated that they anticipate the discovery of additional dead from the 40 new graves that have been located.

On Tuesday, he testified before an ad hoc committee of the Senate that the government has no intelligence information concerning the events that took place in the Shakahola forest, where it is claimed that over 600 people are still missing.

There is a connection between the alleged cult and the notorious pastor of Good News International Church, Paul Mackenzie. Mackenzie is accused of brainwashing his congregation into starving themselves to death to “meet Jesus.”

Mackenzie is still being held in jail by the police.
