Nairobi Woman Representative Esther Passaris has pushed back against claims that she is acting on behalf of President William Ruto by sponsoring a new bill that seeks to regulate public demonstrations.

Passaris stood firm in her support for the Public Order (Amendment) Bill, 2025, which proposes limiting protests near key government offices. She explained her reasons while addressing a rowdy crowd during a National Government Affirmative Action Fund (NGAAF) event.

According to Passaris, she drafted the bill back in October 2024 after chaos broke out during the anti-Finance Bill protests. Protesters stormed Parliament and set part of the building on fire, which she says prompted her to take action.

“I began working on the bill on October 18, 2024. That was after the Gen Z protesters invaded Parliament. Property was destroyed, lives were at risk—people died,” she told the crowd.

She also made it clear that President Ruto only learned about the bill through the internet—just like everyone else.

“When I introduced the bill, it was a private member’s proposal. William Ruto had no idea. He read about it online,” she said.

Passaris also criticized the violent nature of recent youth-led protests, contrasting them with ODM’s peaceful demonstrations in the past.

“When we had issues with the IEBC, we didn’t break in or cause chaos. We met at Uhuru Park, shared our concerns, and submitted a formal letter,” she added.

The proposed law, which mirrors parts of the Assembly and Demonstrations Bill of 2024, seeks to regulate how Kenyans exercise their right to protest under Article 37 of the Constitution. It includes plans to redefine public gatherings and introduce special zones for picketing.

However, the bill has sparked widespread criticism, with many arguing that it threatens freedom of assembly and expression.

Expressing her views on Thursday, May 16, Passaris advocated for a significant hike in the withholding tax on interest income from infrastructure bonds, from 5% to 20%. Her rationale behind this proposal is to dissuade banks from funneling funds primarily into government bonds at the expense of lending to individuals and businesses.

In her words, “The proposed 5% withholding tax on the interest income earned from infrastructure bonds should be increased to 20% to effectively discourage commercial banks, pension funds, and Saccos from solely financing the government. They should prioritize supporting private enterprises rather than the government.”

While justifying the need for these tax adjustments, Passaris highlighted the pressing issue of unpaid bills burdening counties. Additionally, she stressed the importance of improving tax collection processes to prevent the mismanagement and misallocation of public funds.

She asserted, “It’s crucial to tighten our fiscal belt now and demonstrate this through concrete actions. Key sectors like health, education, and security should be off-limits. A populace in good health and equipped with skills within a secure environment is inherently more productive. A prosperous nation starts with a healthy one.”

Passaris’ remarks follow her declaration of support for the Finance Bill 2024, despite widespread discontent among Kenyans due to its proposed tax hikes. In a TikTok video, she praised President William Ruto for his dedication to serving the nation, underscoring her ability to acknowledge and commend positive leadership regardless of her political affiliations. She stated, “My alignment with Azimio doesn’t hinder me from backing the President or appreciating his effective governance. I admire the President and his commitment to public service.”

In 2023, Passaris had previously voted in favor of a similar Finance Bill, resulting in a fine of Ksh250,000 imposed by Azimio. Nevertheless, she remained steadfast in her decision, arguing that the bill was ultimately beneficial for the Kenyan populace.

The unruly crowd criticized the Member of Parliament, alleging that she remained silent while the country witnessed an increase in cases of women being murdered.

“Where were you? Go home! Where were you!” The activists protested against the Orange Democratic Movement (ODM) MP who had attempted to address them at Jevanjee Gardens.

Passaris had to descend from an improvised platform when the audience prevented her from addressing them.

Efforts made by the organizers to bring about a sense of calm proved ineffective, compelling Passaris to opt for participating in the protesters’ march instead.

In the meantime, her security personnel, who prioritized her safety, guided her to a location away from the podium to speak to the press.

In response to the impolite interruption, Passaris explained that she comprehended the perspective of the crowd and acknowledged the validity of their frustration.

She pointed out that she has been actively advocating for the protest, and she intends to take the matter to parliament as a legislator.

“I actually suggested we give the petition to parliament it should be a national disaster,” Passaris stated.

The protest followed recent surges in the systematic killing of women and girls in general because of their gender.

According to recent data released by Africa Data Hub,12 women have been killed due to femicide in the last 24 days.

Nairobi, Kiambu and Nakuru counties have recorded the highest numbers of killings so far since 2016.

“Millions are lamenting except you, your household, and friends alike,” said Elah Valley.

Tom Olango asked the Nairobi Woman Rep to “be realistic mama and speak the truth. No Kenyan is happy”.

“Passaris I will be voting you out in 2027 not because of this post you’ve posted but because of massive betrayal during Finance Bill and how you supported punitive tax proposals at the expense of suffering Kenyans,” another Kenyan said.

Sarah Saassh doubted the legitimacy of the voices that Passaris claimed to be speaking on behalf of.

“Which Kenyan voices? Muthoni which ones? The ones you ignored when you voted for the finance bill?” she posed.

Freddie Mwangi said Passaris had eaten from ODM and was now belching and throwing up on the Opposition.
