Senate Speaker: Letter Cited by Omtatah Withdrawn in Finance Act 2023 Petition
In a significant development concerning the petition against the Finance Act of 2023, Senate Speaker Amason Kingi asserted that a letter cited by Busia senator and activist Okiya Omtatah had been retracted.
Kingi asserted in a letter to the Speaker of the National Assembly that he retracted a June 15 letter warning that the Finance Act 2023 would impact county governments and must be discussed by both houses.
According to court documents viewed on Sunday, July 2, Kingi asserted that the Act does not affect county governments as alleged and was advised to withdraw the letter obtained illegally and filed as evidence in an attempt to mislead the court.
Thus, he argued that the court erred in issuing conservatory orders against the Finance Bill 2023, granting Omtatah’s prayers against President William Ruto’s tax increase enforcement.
“I acknowledge that you wrote to me regarding the consideration of the Finance Bill 2023 in your letter dated 2 May 2023. My letter dated June 15, 2023, was therefore sent in error; I hereby retract it and deny its contents in full.

“Therefore, the position remains as stated in my letter dated 3 May 2023, in which I agreed that, under Articles 95(4)(c), 114,109(3), 209(1), and 221(1) of the Constitution, the Finance Bill (National Assembly Bills No.14 of 2023) is a Bill considered only by the National Assembly, does not concern county governments, and does not affect Senate operations,” the submission stated in part.
Omtatah argued in his petition that National Assembly Speaker Moses Wetangula had not consulted with his Senate counterpart before allowing the Finance Bill 2023 to be read and voted on.
The National Assembly violated Article 110(3) of the Constitution by introducing the Finance Bill 2023 to the plenary without the Senate’s input, he lamented.
In response to Kingi’s application, however, Omtatah told GossipA2Z that the Speaker’s withdrawal was an afterthought and did not affect the court’s decision.
They cannot correct past errors by traveling back in time. They cannot travel through time. The fact remains that the Finances Bill did not undergo concurrence. Nothing in the letter is relevant, so nothing will change.
“The letter was merely a confirmation that it had occurred. Where is the letter demonstrating that there was agreement? Whether he withdraws or not has no bearing on the validity of the letter, Omtatah argued.
According to the activist, the speaker lacked the authority to make statements on his own, and he should have provided a report containing minutes from the council meeting to demonstrate that the decision was not his own.

“It is not about the Speaker’s whims. It involves an examination of a bill, which even the speaker cannot conduct without a committee. That is why we have a panel of speakers.
Therefore, he cannot make decisions on his own, but the decision is not arbitrary. “The decision is structured, so let him produce the minutes of a report on the examination of the various processes to demonstrate that the house’s greed did not affect the counties,” he added.
Judge Mugure Thande of the High Court issued conservatory orders suspending the implementation of the Finance Act 2023 on Friday, June 30.
