Pressure Piles On TSC Over Firing Of 129 Teachers

The Kenya National Civil Society Centre (KNCSC) exerted pressure on the Teachers Service Commission (TSC) on Sunday to reinstate the 129 teachers who had been suspended for requesting transfers from the North Eastern region.

In a statement, KNCSC Executive Director Suba Churchill suggested that, rather than interdicting the teachers, TSC should coordinate with the Ministries of Education and Interior to implement situation-specific policies and measures that will guarantee security in the North Eastern region, thereby restoring the teachers’ confidence.

“They (teachers) need to perform their duties and deliver on their respective mandates in an atmosphere that is secure, enabling, and reassuring,” the lobby said in its statement.

Churchill emphasized that the TSC is violating the rights of the teachers who are Kenyan citizens and impeding their right to security under Article 29 of the Kenyan Constitution by enforcing the ban.

According to Suba, the decision to fire the teachers is ill-advised, given that the national government and the TSC are aware of the security concerns the teachers face in North Eastern while performing their duties.

“To dismiss them merely because they have raised concern that the environment in which they work undermines their security amounts to direct and indirect discrimination by the State on account of their ethnic, social origin,” he added.

Churchill emphasized that the commission should not exploit the teachers by dispatching them to ostensibly dangerous areas and disregarding their welfare.

The prohibition of the teachers has sparked debate across the nation, with numerous politicians demanding that the TSC retract the letters sent to the victims.

Julius Melly, Member of Parliament for Tinderet and Chairman of the Education Committee of the National Assembly, has publicly called for the reinstatement of the instructors.

On Monday of last week, the teachers protested TSC’s decision to fire them by taking them to Upperhill. However, they were dispersed by tear gas and police officers. 10 educators were detained as a result of the confrontation.

TSC interpreted the teachers’ refusal to report to the various schools to which they had been assigned in North Eastern as open defiance, resulting in the interdiction.
