Petitioner Seeks to Block Ruto’s ODM Nominees from Cabinet Appointments
A petitioner approached the court on Friday, seeking to prevent certain members of President William Ruto’s cabinet nominees from being appointed as ministers.
The petition, filed by the Executive Director of the Commission for Human Rights and Justice, aims to block the assumption of office by four Orange Democratic Movement (ODM) party members recently nominated by Ruto.
The petitioner claims that appointing John Mbadi, James Wandayi, Ali Hassan Joho, and Wycliffe Oparanya would undermine the opposition’s role in holding the government accountable.
The petitioner argued that the opposition is constitutionally recognized, and nominating these four would disrupt the balance within the opposition.
He further contended that allowing the opposition to join the government would harm the entire citizenry of Kenya, violating their Constitutional Rights.
“The nomination and appointment of the Interested Parties into the cabinet as secretaries would conflict with their constitutional duty as members of the opposition party,” the petitioner stated.

“This would also conflict with their duty, as mandated by the people of Kenya and the constitution, to oversee the government.”
The petitioner also called for an order to stop the vetting process for the four ODM members’ cabinet positions.
“It is fair and just that the matter be prioritized and the requested orders granted to protect the constitution from being violated by the Respondents,” stated the Director of the Commission for Human Rights and Justice.
This development comes just two days after President William Ruto announced the nomination of the second batch of cabinet secretaries.
During a press conference at State House in Nairobi, the Head of State nominated ODM’s John Mbadi (Treasury), Opiyo Wandayi (Energy and Petroleum), Ali Hassan Joho (Mining), and Wycliffe Oparanya (Ministry of Co-operatives).
Ruto’s decision to include opposition leaders in his administration follows his promise to establish an inclusive and broad-based government.
