Perks and Pay Rigathi Gachagua Risks Losing if Senate, Court Uphold Impeachment

Deputy President Rigathi Gachagua has been impeached by Members of Parliament (MPs) for alleged gross misconduct.

On Tuesday, October 8, a total of 281 MPs voted in favor of all 11 charges against Gachagua, which include violations of the constitution.

The Senate will now determine Gachagua’s future by voting on each of the 11 charges included in the impeachment motion.

If the Senate upholds the decision of the National Assembly, Gachagua may turn to the courts for recourse.

What are the consequences for Gachagua if removed as Deputy President?

Should the Senate and courts approve his impeachment, Gachagua stands to lose not only his salary but also various perks, including retirement benefits.

According to the Salaries and Remuneration Commission (SRC), the Deputy President is entitled to a gross monthly salary of KSh 1.22 million, along with additional benefits.

Upon removal from office, Gachagua will forfeit his monthly salary and the following benefits:

Official Transportation

As part of his role, the Deputy President is provided with official transportation, following the government’s transport policy.

This privilege will be revoked if Gachagua is removed from office.

Medical Benefits

Gachagua, along with his spouse and up to four children under the age of 25, receives a comprehensive annual medical package.

This includes inpatient coverage of KSh 10 million, outpatient coverage of KSh 300,000, maternity coverage of KSh 150,000, dental coverage of KSh 75,000, and optical coverage of KSh 75,000. This benefit would be lost following impeachment.

Retirement Benefits

The SRC outlines that a state officer serving a fixed term is entitled to a service gratuity of 31% of annual pensionable emoluments for their term.

In cases where a pension scheme exists for state officers, the SRC will assess and determine employer contributions and other retirement benefits.

It remains unclear if Gachagua would retain his retirement benefits if impeached, as the SRC does not specify the outcome for dismissed officers.

Gachagua’s wealth under scrutiny

In his defense during the impeachment trial, Gachagua provided details about his wealth, a focal point of the 11 charges against him.

The National Assembly heard accusations of Gachagua’s alleged KSh 5.2 billion fortune, which Kibwezi MP Mwengi Mutuse argued could not have been accumulated in just two years.

Gachagua countered these claims, asserting that it took him 15 years to amass his wealth, primarily during former President Mwai Kibaki’s administration.
