Nairobi Governor Issues 24-Hour Notice to Defaulting Landlords

On Sunday, June 25, Nairobi Governor Johnson Sakaja issued a 24-hour notice. To landlords operating within the county who had failed to pay land rates.

The county announced in a public notice that it will begin cracking down on defaulters beginning on Monday, June 26.

The directive was issued one day after the county government’s 14-day notice. To landlords to pay their delinquent land rates expired.

The legal notice and forthcoming crackdown were announced by Patrick Analo Kivaga, the Physical Planner and Head of County Public Service who is also the acting County Secretary.

Sakaja stated that following the 24-hour notice, he would flag non-compliant properties and require their tenants to pay rent directly to the Nairobi County Government.

“The payment will continue until all outstanding arrears have been cleared,” defaulters were warned.

“The legal process to auction the property to recover the outstanding arrears will commence,” Sakaja added.

To avoid embarrassment and loss of property, property owners were urged to take note of the notice and ensure compliance with their properties.

Landlords in Kenya who wished to make timely payments were instructed to dial *647# to receive further instructions.

Alternatively, landlords were informed that they could access payment amounts via www.nairobiservices.go.ke.

The notice continued, “Property owners may obtain invoices and bank information from City Hall or any of the 17 Sub-County Offices.”

Section 18 of Title 267 of the Ratings Act guarantees the auctioning of properties by county governments.

“The rating authority shall be entitled to retain, out of the proceeds of any rate levied to meet liabilities for expenses of any council, the cost of levying and collecting such rate or 2.5% of the given proceeds of that rate, whichever is less,” states the law.
