MP Peter Salasya Skips Court In Assault Case, Claims He’s Unwell
On Tuesday, Peter Salasya, the Member of Parliament for Mumias East, was unable to attend court to address accusations of assault and bodily harm. He cited health issues as the reason for his absence.
Mumias Senior Resident Magistrate Marcella Onyanya consequently directed the legislator to personally appear in court on Wednesday.
Magistrate Onyanya also instructed the investigator managing the case to furnish the court with a thorough medical document from Aga Khan Hospital, where MP Salaysa was purportedly hospitalized.
The legislator, who sparked controversy, faced charges of assaulting Peter Walunya Indimuli, the MCA of the Malaha-Isango ward, during a funeral last Friday. Subsequently, the legislator was granted release on a cash bail of Ksh.50,000.
Arnold Magina and advocates representing the complainant requested the court to revoke the bond conditions for the accused due to his non-compliance with court orders by failing to appear.
According to Mr. Magina, Salasya, like any other suspect, should have followed court orders and appeared in court to address the charges. Since Salasya failed to do so, Mr. Magina suggested that his cash bail be surrendered to the State, and a warrant of arrest should be issued against him.
The representative proceeded to contend that there was no documentation submitted to the court explaining the reason for MP Salasya’s absence. Additionally, the advocate refuted assertions that the MP was hospitalized, thereby refuting any justification for his nonattendance at the court session.

“Let the accused file a report to this court indicating when he was admitted and under what ailment so that we can all be satisfied that indeed he is unwell. He has just posted on his social media platform a few minutes while the court was in session,” he stated.
“If he has the stamina to post yet we are told he cannot attend court it’s very unfair because that is very evident that he can address the court.”
Furthermore, the supporter alleged that the lawmaker was intimidating crucial witnesses involved in the case and likely located in the Ekero region rather than being hospitalized as asserted.
Mr. Magina’s feelings were supported by the investigative team, which stated that its monitoring data indicated the Member of Parliament was in Ekero, Mumias, and not at the Aga Khan Hospital as claimed.
Therefore, the prosecution urged the court to review the defendant’s records and determine a more appropriate penalty.
“The accused has chosen not to respect the court. His advocate, Harmston Maloba, indicated that he was admitted to the hospital but has not provided evidence of the same. Warrants should be issued against him and mention date placed before this court latest on Friday,” said the prosecution.
Maloba, the attorney representing MP Salasya, refuted accusations of witness intimidation in the case, dismissing them as unfounded allegations.
