Millions of Mathe Wa Ngara Frozen by Court

The High Court has ordered that the Sh 13,400,000 seized from suspected drug trafficker Nancy Kigunzu be deposited into the Assets and Recovery Agency’s (ARA) preservation account at Kenya Commercial Bank.

Lady Justice Diana Kavedza stated that the Agency must produce a copy of the deposit receipt as evidence in court.

The orders were issued in response to an emergency application lodged by the Agency alleging that the funds may be proceeds of crime or intended for criminal activity.

Early in the week, Kigunzu was apprehended and subsequently arraigned at the Jomo Kenyatta International Airport.

The police requested that she be detained for an additional five days pending further investigation of the case.

The petition was granted by Chief Magistrate Njeri Thuku.

Thuku also directed the Central Bank of Kenya to hold the Sh 13,4 million seized from her during the police raid on the drug den in Ngara. Kigunzu is scheduled to return to court on Monday of next week.

Friday, the Agency informed the court that the DCI had also arrested Eugene Jumba, Hillary Shisiali, and Teresia Wanjiku Mwihaki, all of whom are believed to be couriers, associates, and close relatives of Kigunzu.

During the arrests, a search of Kigunzau’s residence yielded 30 sacks containing 622 kilograms of dry green material suspected to be cannabis sativa along with Sh 13,4 million.

The Agency stated, “Preliminary investigations established that there are reasonable grounds to believe that the funds were obtained through the illegal trade of narcotic drug substances, and are therefore proceeds of crime.”

The preservation orders will continue to be in effect for the next ninety days.
The matter will be discussed before Lady Justice Maina on November 28.
