Deputy President Rigathi Gachagua is facing a serious threat to his position, with the Senate set to determine his future as the second-highest official in the country.

Despite his efforts to avoid it, Gachagua’s fate now rests with 47 Senators, who will deliberate on the impeachment motion against him in sessions scheduled for Wednesday and Thursday.

On Wednesday, October 16, the Senate hearing began, and Gachagua received another setback when the court denied his request to halt the impeachment process. This marked the second time in 12 hours that his attempts to stop the trial were unsuccessful.

As the clock ticks down on his time as Deputy President, a major legal confrontation is expected. The National Assembly has assigned a top-tier legal team led by Siaya Governor James Orengo.

Governor James Orengo brings a wealth of legal expertise and a deep understanding of the Kenyan constitution. Having served two terms as a Senator, he is highly experienced in navigating Senate proceedings.

Orengo will lead a team of 14 skilled lawyers. Among the legal heavyweights supporting him are Paul Nyamodi, Eric Gumbo, Moses Kipkemoi, Muthomi Thiankolu, Peter Wanyama, Kenny Kipkoech, Joan Cheruto, Erick Mwingi, Bonface Mawira, Kevine Otieno, Alex Mboya, Kennedy Kyalo, and John Mwangi.

Gachagua’s Defense Team

Deputy President Gachagua has assembled a formidable legal team of his own, headed by senior counsel Paul Muite, who is known for his ‘old-school’ legal approach.

Other top lawyers defending Gachagua include Elisha Ongoya, Tom Macharia, Victor Swanya, Ndegwa Njiru, John Njomo, Faith Waigwa, Amos Kisilu, George Wandati, George Sakimpa, Andrew Muge, Eric Naibei, Julia Omwamba, and Willis Echesa.

Gachagua’s legal team is expected to present key witnesses in their last effort to dismantle the accusations brought against him.

The Deputy President faces 11 serious allegations, including abuse of office, undermining the Office of the President, and economic crimes.

Rumors are circulating that a new Deputy President could be appointed before the Mashujaa Day celebrations in Kwale on October 20, although no official statement has been made yet.

Should the impeachment go through, Gachagua’s final recourse would be to challenge the decision in court. While the court refused to halt the Senate trial, a three-judge panel—comprising Judges Erick Ogolla, Antony Mrima, and Frida Mugambi—assured Gachagua’s legal team that he could still appeal the Senate’s ruling post-impeachment.
