Kisumu Senator Tom Ojienda Files Petition Against ODM
Tom Ojienda, a senator from Kisumu, has filed a petition challenging the Orange Democratic Movement’s (ODM) decision to expel him.
Along with Phelix Odiwuor ‘Jalang’o’ (Lang’ata), Caroli Omondi (Suba South), Elisha Odhiambo (Gem), and Gideon Ochanda (Bondo), Ojienda was one of four members of parliament expelled for associating with President William Ruto.
The legislator, through his attorneys, Prof. Tom Ojienda and advocates, filed a petition with ODM requesting documentation of the proceedings preceding his expulsion.
In a letter dated September 7, the Senator from Kisumu clarified that he had not yet received an official notification from the party leadership confirming his removal.
“Despite this being an extremely adverse decision against our client, you are yet to personally serve him with any communication regarding his expulsion” read part of the statement.

“In the light of the above, we are writing to request for immediate production of proceedings and documents relating to the expulsion.”
In addition, the attorney wants ODM to be compelled to disclose the disciplinary tribunal’s recommendations regarding his fate.
The one-term senator also requests that the party disclose the complete minutes of the meeting that preceded the unanimous vote to expel him.
Ojienda remarked that he learned of his fate via an ODM press briefing in which nominated Senator John Mbadi announced the party’s decision.
“The members be deemed to have resigned from the ODM and the party is hereby directed to commence the process of removing them from the register of ODM,” Mbadi stated in the presser.
During the press briefing, Mbadi announced that Mark Nyamita of (Uriri) and Paul Abuor of (Rongo) must apologize to the party in writing and pay an additional Ksh1 million.
