Kenya Pipeline Ex-CEO Tanui Cleared in Sh644m Graft Case; MP Sudi Acquitted of Forgery

Former Kenya Pipeline managing director Charles Tanui and fifteen others have been cleared of charges related to a conspiracy to defraud the parastatal of Sh644 million.

Anti-corruption Magistrate Felix Kombo stated that the conspiracy charge was unsubstantiated, noting that such a charge requires a demonstrable agreement among the accused.

He emphasized that there was no evidence indicating a collective intention among the accused to defraud the Kenya Pipeline company.

Nevertheless, the court determined that some of the accused must still face trial for other fraud-related allegations.

These individuals will need to defend themselves against these specific accusations.

The case pertains to a tender involving the supply of Hydrant Pit Valves and accompanying operational spares from Aero Dispenser Valves Company Limited.

The accused were charged in December 2018 concerning the misappropriation of public funds in procuring 58 Hydrant Pit Valves to replace malfunctioning ones at the Jomo Kenyatta International Airport.

Hydrant pit valves are essential for refueling aircraft.

Win for MP Sudi as court acquits him in forgery case

Kapsaret MP Oscar Sudi has been acquitted by a Magistrates court of charges related to forging academic certificates.

Magistrate Felix Kombo ruled that the prosecution failed to present a compelling case against Sudi, thus negating the need for him to present a defense.

The magistrate highlighted that the lack of production and verification of documents invalidated the charge.

Additionally, he criticized the investigative process, particularly regarding how some evidence was obtained.

It was noted that part of the evidence was acquired from a hotel, which the magistrate indicated compromised its credibility.
