Judiciary Demands Retraction from Citizen TV over Swearing-in Statement

The Judiciary demanded that Citizen TV retract a reporter’s statement regarding the swearing-in of Chief Administrative Secretaries (CAS) on Tuesday, July 4.

In a statement, the government arm led by Chief Justice Martha Koome objected to a journalist’s report in a news bulletin that the judiciary swore the 50 CAS who were prohibited from assuming office.

The Judiciary emphasized the need for Citizen TV to clarify the report, which allegedly misled the public and tarnished the Judiciary’s reputation, deeming the claims false.

“Focus has been drawn to a misleading report that aired on Citizen TV’s Monday Night Report on July 3, at 9:00 p.m. In the news article, the reporter claims that the Judiciary redeemed itself after a three-judge bench of the High Court issued a ruling.

The statement read in part, “The Judiciary, therefore, requests that Citizen TV and its editorial management retract the misleading statement and correct the record as instructed.”

In a report that aired on Monday, July 3, it was stated that the ruling of the High Court was vindicated after the CASs were improperly sworn in.

Citizen TV aired its report against the backdrop of three High Court justices, Kanyi Kimondo, Hedwing Ong’udi, and Visram Alnashir, declaring the CAS position unconstitutional.

The judges determined that the 2010 Constitution of Kenya did not foresee the appointment of 50 judges, an increase from the 23 judges appointed by former President Uhuru Kenyatta.

“Judiciary, long accused of aiding and abetting Executive impunity by participating in the swearing-in of the CASs whose offices have now been declared unconstitutional, has redeemed itself for this judgment,” the reporter claimed.

Therefore, the Judiciary maintained that it has no role in the inauguration of Cabinet members and other state appointees.

A portion of the statement read, “No official of the Judiciary was sent to State House to swear in the fifty Chief Administrative Secretaries (CASs).”

On Thursday morning, March 23, President William Ruto and Chief of Staff Felix Koskei presided over the swearing-in of fifty Chief Administrative Secretaries at the State House in Nairobi.

At the time of publication, Citizen TV had not yet issued a response.
