Judge Commands Mwangi Wa Iria’s PA to Face EACC Monday

The High Court has directed the former Murang’a Governor Mwangi wa Iria’s assistant to present themselves at the Ethics and Anti-Corruption Commission on Monday.

Judge Nixon Sifuna of the Anti-Corruption Court ordered Peter Muturi Karanja to provide a statement and submit to fingerprinting at the offices of the Ethics and Anti-Corruption Commission (EACC).

This pertains to the investigation of the alleged embezzlement of Sh140 million in Murang’a County.

“Hence he should on Monday the 22nd day of April 2024 present himself to the Ethics and Anti-Corruption Commission for recording a statement and fingerprint taking, and then on Tuesday the 23rd day of April 2024 at 9:00 am present himself to the Milimani Chief Magistrate’s Anti-Corruption Court, for plea-taking in ANTI- CORRUPTION CASE NO. E012 OF 2024 wherein he is the 8th Accused Person,” Justice Sifuna ordered.

Karanja sought an urgent certificate from the High Court to prevent the EACC from detaining him.

Following discussions, the Court ordered him to post a cash bail of Sh300,000 by the end of the day on Friday.

Justice Sifuna explained that the anticipatory bail was intended to prevent arrest but did not cover being charged or prosecuted.

Furthermore, the judge specified that the protective orders obtained from the Murang’a High Court by Mwangi Wa Iria only halted the prosecution of three individuals: the former governor, Jane Waigwe Kimani, and Solomon Mutura Kimani.

As such, the other suspects should proceed to take a plea.

“I am in making these orders and conditionally stopping his arrest, cognizant of the fact that the Applicant together with nine others have already been charged in the said case but are yet to take plea. Therefore, while he should not be arrested, he should co-operate and liaise with the Ethics and Anti-Corruption Commission and the Director of Public Prosecutions for purposes of being processed for plea-taking,” Justice Sifuna ordered.
