Jack Smith’s Final Report: Evidence Was Enough to Convict Trump if Not Elected
Special Counsel Jack Smithโs closing report on the investigation into Donald Trumpโs efforts to overturn the 2020 election is a scathing critique.
While much of the report recaps already public detailsโlike Trump allies pushing fake elector schemes and pressuring thenโVice President Mike Penceโit underscores the gravity of the charges against the president-elect.
Smith boldly stated that the evidence presented would have secured Trumpโs conviction if not for his reelection. The report directly links Trump to attempts to undermine the election results, overturn Joe Bidenโs victory, and regain power unlawfully.
โSubstantial evidence demonstrates that Mr. Trump engaged in an unprecedented criminal effort to overturn the legitimate election results to retain power,โ the report asserts.

In response to claims of bias, Smith defended the investigationโs integrity against accusations of political influence from the right. โWhile we could not bring the cases to trial, standing firm for the rule of law matters,โ Smith wrote in a letter to Attorney General Merrick Garland included in the report. โThe example we set in fighting for justice, despite personal risks, is significant.โ
The report also highlights Trumpโs attempts to disrupt the investigation, citing his use of social media to target witnesses, courts, and prosecutors. These tactics prompted Smithโs office to pursue a gag order. โMr. Trumpโs reliance on intimidation and harassment mirrors his conduct during the charged conspiracies,โ Smith noted.
Released just days before Trumpโs inauguration, the report came after a failed appeal by Trump to block its publication. Judge Aileen Cannon denied his request late Monday night, allowing the reportโs release.
