IEBC Ordered to Pay Ksh.248 Million to Scanad Kenya for 2017 Services
The Independent Electoral and Boundaries Commission (IEBC) was required to pay Scanad Kenya Limited over Ksh.248 million for services rendered in 2017.
“An order of mandamus compelling the respondents’ chief executive officer to pay the applicant the sum of Ksh.248,042,665.12 plus interest at the court rate from the date of award until full payment,” according to court documents.
The court has ruled that IEBC Chief Executive Officer Marjan Hussein must show cause as to why he should not be cited for contempt.
The decreed amount stems from 2007 services rendered by the company to the commission.

A court in Nairobi initially ruled in favor of Scanad, with Lady Justice Grace Ngenye ordering IEBC to pay the advertising agency Ksh.245,002,620.12 on April 26, 2021.
The commission, as stated by Scanad in its notice of motion, claimed it was unable to pay the amount because the National Treasury had not provided it with the necessary funds.
Scanad went on to say that, despite numerous demands, the electoral body “deliberately failed, refused, or declined to comply with the decree.”
“Furthermore, the Respondent has not appealed or set aside the Decree or Certificate of Costs at issue in this application, nor has any attempt has been made to contest the Court Order,” according to court documents.
“The Respondent was properly served with the Certificate of Order for Costs against the Government on October 6, 2022, and a proper demand for payment was made.”
John Chigiti ruled that the commission has not yet provided a sufficient explanation for why it has not complied with the court order to pay Scanad.
