High Court Grants Urgent Certification for Azimio’s Petition on Shakahola Deaths Probe

A petition that challenges the appointment of a judicial commission to investigate the deaths of Shakahola residents has been designated by the High Court as an urgent matter.

Judge Hedwing Ongudi of the High Court issued the orders on Wednesday and further directed the petitioner, which is the Azimio la Umoja opposition coalition, to serve the respondents in the case.

Respondents in the case will submit their responses no later than May 18, 2023, and they will appear in court on May 22, 2023, for mention to confirm compliance with the terms of the case.

The Azimio party has filed a lawsuit against the commission that was sworn in yesterday. Arguing that the move by President William Ruto is unconstitutional. Because it amounts to a usurpation of powers that the Constitution has vested in other state organs. The lawsuit was filed in the High Court of Kenya.

The coalition contends that the president’s action would compromise the impartiality of the Commission of Inquiry. Because its members will be required to report to the president.

Raila Odinga, the leader of the Azimio party, has been praying for the president’s move to be reversed. He is adamant that the president did not have the constitutional authority. To form the commission of inquiry, and that the responsibility for doing so lay squarely at the feet of parliament. Additionally, Odinga believes that the Judicial Service Commission should have found and recruited qualified individuals to serve on the tribunal.
